  3. Hi all, I wonder if anyone can help me... I am on my second 417 visa which is due to expire October of this year. I'm currently working in Melbourne and living with my partner who is an Australian citizen. I'm planning on applying for the 189 visa as a secondary school teacher and have calculated that I have 85 points. I have completed my skills assessment and IELTS test and am ready to send off my expression of interest. However I did have a few concerns about the process; 1. When completing the expression of interest I was asked about my relationship status, I am not sure whether I classify as "never married" or as having a "de facto partner", my partner and I met over a year ago and having been living together for about 3 months now. I wasn't sure if this counted as de facto as I have read a number of conflicting things, e.g. for some purposes you're de facto as soon as you start living together, others its 12 months or 24 months. As I'm applying for 189 visa this doesn't make a difference for the points I'll receive as now you get the extra 10 points regardless of whether you're single or with an Australian PR/citizen, what I'm concerned about is the 8515 condition that will probably be attached to my visa if I state that I'm single (8515 - You must not marry or enter into a de facto relationship before entering Australia. We might cancel your visa if we find out you were engaged, married or in a de facto relationship before we granted you the visa but did not tell us.), or if I state de facto and am then asked for evidence that we've lived together for 12 months, which we wouldn't have. Just trying to fill out the form honestly but very unsure. 2. I'm planning on visiting the UK twice this year in April and July and my other concern was that if I get invited to apply then I have 60 days to lodge my application so it could end up that I've had to do this before my trips, and I'm aware that the visa itself could take between 4 and 11 months to be processed. When I applied for my second WHV after completing my farm work I was told that if I was in Australia when I applied then I would have to be in Australia when it was granted, I got a bridging visa A which also stated that I couldn't return to Australia if I left. I understand that the bridging visa only activates when your current visa expires, my 417 WHV doesn't expire until October 2020. So my question is...If I lodge my 189 application before the trips, can I still travel to the UK in April and July? I'll still have a valid 417 visa for this period, but would the Australian government require me to remain here until my visa has been processed? My original plan was to do everything ASAP because I really need to get the application lodged before my current visa expires so that I can get the bridging visa to stay here rather than having to return to the UK lodge form outside Australia. I thought that the process would be very long, I assumed that it would take ages for the skills assessment to be ready (this was done pretty quickly) and be a minimum of 3-4 month wait for your EOI to render an invitation, but form recent forums there have been some teachers with 70-75 points that say they got invitations within a month, some just 24 hours after submitting an invitation. I prefer to get things done sooner rather than later but I don't want to jeopardise either trip as its been nearly two years since I've seen my family and I'm not keen to wait until after the visa has been processed, but on the other hand it would make life very difficult if it did take longer and I didn't get it done before my current visa is up in October! I've spent the last few days scouring forums and reading the information on the government website but couldn't find anything similar to my situation and am still unsure as I know that the immigration department can be very strict and pedantic.     E Visa Delay Australia

    I have been travelling to Australia for many years as my sibblings lives in Tasmania and my parents are buried in Tasmania. I applied for A evisitor visa back in October 2018 and it is still being processed because I have a criminal record in 1989 which I have declared in the past and allowed entry. My brothers and sister are all getting old and I am denied visiting them and my sister and parents grave. What di I have to do to get them to grant me my visa?

Hi All, One of the Australian citizenship (by conferral) eligibility requirement is "living in Australia on a valid visa for the past 4 years" If I wanted to apply for Australian citizenship in Jan 2023 - does my 4-year count start on Mar 2018 OR only on Jan 2021 because I have a gap in holding a valid visa? Basically am I eligible to apply for citizenship in Jan 2023 assuming I meet all other non-residence requirements? Mar 2018 - Mar 2020 on 457/TSS visa Apr 2020 - Dec 2020 on no visa (left Australia after applying for SC190 visa) Jan 2021 - Dec 2022 on PR Thanks!

  7. Hi Friends, I am a specialist doctor and need some guidance on 189 or 190 visa application. I completed my specialty training from India and applied to AMC & RACP for assessment of my training/education. RACP found me fully comparable to an Australian trained specialist and after completing 12 months of peer-review practice, I got my specialist registration. Now I want to apply for 189/190 visa. I want to claim points for my previous work experience in medicine & the specialty field. I checked Govt immi website and it says assessing authority is Medical Board of Australia. But on Medical board website, there is no mention that they will assess the previous work experience for points in immigration. I have called them also and they confirmed that they do not assess previous experience. Please help with the below: 1) How to get points assessed for the previous work experience 2) Do I need to get around 80 points to get the invitation, or is it less for a doctor (as very few people apply in my occupation) Any help would be highly valued. Thanks!!
  8. Hi, Quick question, I am trying to transfer a 457 visa to another employer and I have been waiting for 8 weeks now without a reply from the immigration. I have tried to push it with the lawyer but still nothing. Any suggestions on how to move forward with this? I can’t keep waiting for too long as I am currently unemployed?   9. Hello people~ I need help to understand the residence calculator on DHA website. Very confused. It says before applying for Citizenship, you must have lived in Australia lawfully for 4 years, including 1 year as a permanent resident. And you cannot have been outside Australia for 12 months total, during the past 4 years. So I did enter my dates in the calculator as seen below. Permanent Residence Date: 31/08/2019 Lawful Residence Date: 07/02/2016 Intended Lodgement Date: 11/09/2020 and the absence dates: From Date: 05 Jun 2016 To Date: 02 Feb 2017 From Date: 30 Apr 2017 To Date: 01 Aug 2017 From Date: 01 Oct 2018 To Date: 23 Dec 2018 From Date: 03 Dec 2019 To Date: 20 Jan 2020 Now the calculator says yes I can apply for Citizenship but we can clearly see that I've been out for 17 months...it doesn't make sense. Also..should I count from the first visa I got in Australia? which was in 2008. or the first visa i got 4 years before the citizenship application. Any help or clarification would be greatly appreciated! Thank you!

Hi all! after a little advice (and I’m sure it’s in here somewhere but we have a LOT of posts) I’ve recently moved back to Sydney (worked in the UK for two years, missed it so much, and decided here is where I belong) and although I am originally British, I now have dual citizenship (thank goodness I got that after 8 years here) my question is - my mum (only remaining relative - 69, healthy enough, retired, but without a pension, she owns her house and has no debt though) is in England. I miss her so so much. I realise visa wise it would take forever, or involve lots of money (once I’ve been back here 2 years) for her to move here. however...the dream is I could spend a couple months in the UK each year (I’m freelance, well starting my own business, so long term will be possible) and she could come stay with/visit me for terms. how long is she allowed to stay here, each year or at a time? And if (I doubt it but you never know) she ever needed a doctor, or severed a limb...would we/Australia leave or help!? i know slightly silly/obvious questions but I’m keen not to be all excited about her coming here for a few months at a time, if it’s really impossible. thanks so much lisa
  14. Hi all, My partner and I will have been living together for 12 months in July and want to apply for the Partner Visa (de facto). I'm Spanish and he is Australian and we are living in the UK. We don't know whether to apply offshore or move to Australia and apply from there. We both have stable jobs but we both feel we are not progressing and want better opportunities in Australia. We are concerned about the difficulty for me to get a qualified job (graphic designer) while I'm on a Bridging Visa. We would like to move around January 2020 to Australia. His UK visa expires in November so he would have to renew it if we decide to apply offshore. Our options are: A) Apply in July for 309 visa and pay for his visa in the UK with the potential risk of having to stay in the UK for over another year. B) Move to Australia when his visa expires and I'll go there on a tourist visa – eVisitor subclass 651 which doesn't have the condition of no further stay – with the risk of not getting work rights on the bridging visa when I apply for the 802 partner visa on shore. I read it is possible to ask for the right to work but I don't think it is guaranteed. Most of the jobs offers that I'm seeing right now require Australian citizenship, permanent residency or rights to work on an ongoing basis. I'm not sure if the bridging visa or even the temporary partner visa would satisfy this requirements. Which route is best to take? Thanks!

    2 week trip, potential travel buddy?

    I’m hoping to go to Australia this year for 2 weeks. I’m limiting myself to 2 weeks because I’m still currently studying at uni so can’t come out for an extended period of time. I have been to Australia before, back in 2013 was my first time, and although I’m willing to go out to Australia for 2 weeks on my own, it would be good if there is anyone of a similar age (I’m 23) that fancies jetting off and is someone who I can get to know before hand. I ask as currently none of my friends are up for it and it’s pretty daunting to go solo. Thanks

    Looking for a migration agent

    My husband and I are searching for a migration agent to help us with our case. We are wanting to move from England to Australia, and I’ve spent quite a long time trawling through google, but there is just so much information, it’s a little overwhelming. We’ve come to realise it can be a little difficult to differentiate what is legit or not as we’ve come across ones that look really good and have been in contact with some, only to delve a little deeper to find that it may be a scam. Obviously when handing money over to someone, I want to be sure that it’s the right someone! Any advice anyone has or recommendations would be greatly appreciated.

    Thinking of moving to Australia

    I'm 32 and thinking of moving to Australia. I don't have a degree but do have A levels currently living in Bristol I have no criminal record but only work in temporary jobs don't have a specific skill of profession as such. Would I still be able to move there? Also, what are the negatives and positives of life there compared to the UK? The main reason I want to move is because I am really tired of this country the weather and lack of space etc Also I want to have different experiences and a change.
  20. Hi guys!! I am the sponsor while my fiance (applicant) is living in the Philippines. We have met in person but majority of our relationship was long distance. We are so close to gathering all our documents and requirements, and we are planning to lodge our application in March 2019. I just have a few concerns and would appreciate some advice! ♥ ♥ - quick relationship background - * We first met as friends in 2011 at our high school. I migrated to Australia in 2013, and our relationship started/developed when I reunited with him when I went on a vacation to the Philippines in Feb 2017. (This was the only time in 2017 where we were physically together, for around 2 weeks only) * Ever since I went back to Aus in March 2017, we have remained in contact and continued our relationship. We started talking about our future and getting married in Australia constantly throughout 2017 to present. QUESTION 1: Does this count to 'when we got engaged'?? or only when he actually proposed to me with a ring? Is there a certain requirement for how long we are supposed to be engaged for? * I went on a vacation to visit him in the Philippines twice in 2018. (first visit was for almost 2 months, and second visit was for 1 month). We did talk about him getting a tourist visa but he has not yet had the opportunity to visit me in Australia due to college and work (and He has never tried travelling to other countries before, but he got his passport earlier this year) QUESTION 2: Is that going to be an issue to be concerned about? Does he need to visit me in Australia first prior to lodging our visa? * We both met each other's family in 2018. I only have 3 photos together with us with my family, and only 2 photos of us with my fiance’s family. (We met up way more times than this, but we just did not take lots of photos back then when i was in the philippines twice in 2018). As for friends, we also only have 1 photo with our friends in 2018. Our friends are graduating from college and some are working full time, causes a clash in our schedules which is why we didn’t really get the chance to spend more time with our friends (plus we were honestly focused on spending our limited time of being physically together alot more) Will this be an issue of concern? Do I need to provide more photos than this? QUESTION 3: Will this be a problem? Do I need to supply more photos than that? * As of now, I will be visiting him in the Philippines again for a month in mid January 2019, and in February we are going to be travelling together for the first time (and his first time travelling in general) to Singapore for our 2nd Anniversary. * During my time in the Philippines in Jan-February 2019, We are planning to get his medical exams done there in advance and then lodge our visa in March 2019. As for our Notice of Intended Marriage, I am planning to get that done in early January 2019 before I leave Australia to go to the Philippines. QUESTION 4: Will this be okay to get these documents a month prior to lodging our visa? Is it allowed? These are also a list of relationship evidence requirements that I have gathered so far: - 2017 call logs and message history - 2018 call logs and message history - 2017 social media posts - 2018 social media posts - receipts of gifts we gave to each other (with bank transactions) - receipts of our hotel bookings (with bank transactions) - receipts of uber ride histories showing us visiting each other’s houses, going to our hotels, dates, etc (with bank transactions) - timeline of our relationship that shows photos of significant events and joint activities - receipts of times money was sent to fiance through remittance website (with bank transactions) - receipts of our hotel and flight bookings for our trip to singapore in feb 2019. QUESTION 5: in regards to ‘ proof that you and your prospective spouse have met face-to-face as adults since turning 18 and know each other personally’ in our written statement it is mentioned that we met in 2017 when we were 19 years old. What other evidence can I provide for this section? Question 6: in regards to ‘proof that you and your prospective spouse genuinely intend to live as spouses’ We included talking about our plans to live together in our written statements and also included screenshots of chats/messages about this, as well as links of rental properties we both liked that we sent to each other. Question 7: I only have 3 photos together with my fiance and my family, and only 2 photos of me with my fiance’s family. (We met up way more times than this, but we just did not take lots of photos back then when i was in the philippines twice in 2018). Question 10: In regards to fiance’s Form 80 Character assessment.. My Fiance does not hold a bachelor’s degree since he decided to stop his university studies mid 2018 in order to work full time (his first job) to help save for our future and for the visa. Will this affect our application, or give a bad impression ? Question 11: Since philippines is a high risk country, does that mean processing time for our visa will take longer? IM SO SORRY for the long post and the many questions. I am just feeling scared and overwhelmed, only a couple more months until we plan to lodge our visa! We really want to be approved same as everyone else.. We truly appreciate it if you could let us know anything we are missing, any kind of advice, suggestion, or important info!   21. Hi, I have applied for Australian citizenship and met all the criteria. However, after applying, I had to move back to the UK for family reasons so no longer have an address in Australia. I received the citizenship test notification just now and will fly back to Australia to sit the test. My two questions: 1. Does moving back to the UK before the citizenship test effect my application at all? 2. Do I need to update my application to show my UK address? Thanks in advance!
  22. The Migration Amendment (Family Violence and Other Measures) Bill 2016 has at long last had its second reading in the Senate, and was passed this morning. Some will recall that this is the legislation that the Federal Government considers is required to pass into law before the long awaited temporary parent visa can become available. We are anticipating the Bill will become law this week, at which point we can reasonably expect the new temporary parent visa pathway will open. Hopefully this will be prior to the Parliament rising for the Christmas recess. The legislation as drafted requires the approval of a sponsor before a visa application is lodged. The Bill now returns to the House of Representatives for a vote. If the Bill passes the House without any amendments it should receive Royal Assent and become law, after which the drafting of regulations will be necessary to give it practical effect. Those who are interested in progressing an application for the new temporary parent visa with our help should feel able to send a PM or an email to me - or to any other registered migration agent .who is doing parent visa work.
