  1. Hi everyone, we submitted our app to London on 8/8, three weeks later told payment info was wrong and had a day to get it in before fees went up. So we did that and were told it would be sent to CO. It's now 3 weeks later and no contact from anyone.?? I thought after payment taken CO granted would be 3/4 days after and make contact?? Are there a lot of people waiting if you have recently submitted. Is there a general number/email to contact to see what is going on?? Or do I just wait and hope they haven't 'misplaced' our application. Freaking out right now..
  2. Hi everybody, I am lodging my offshore partner visa 309 at the end of this month. I just wanted to triple check my checklist of documents I have physically in the envelope and have a few questions .. Checklist : Form 47sp filled Form 47 filled Certified copies of passports for both of us Certified copies of birth certificate for both of us 4 passports photos for both of us 4 forms 888 by australians friends and australian family on my partners side, signed and certified by a third person French police clearance Uk police clearance PAPERS FROM THE SPONSOR : Certified copy of birth certificate Paper showing employments EVIDENCES : Electricity bills with both our names on it -Flat rental with both our names on it Flat contract with both our names on it Wedding invitation with both our names on it Deposits with with both our names on it 2 Gym contract of the same Gym Some photos of us in France, Uk, Prague, with my family 1 letter from sponsor to express love 1 letter from me Is this all and enough ? I can't seem to find something missing. These are my few questions : 1 - Does the love letter have to be certified or something ? Or just on a piece of paper with our name and signature ? 2 - When are they going to contact me for the health check ? Are they going to book an appointment for me in my nearest hospital ? How does it work ? 3 - When you give the evidences, for example a renting flat contract, do you print the whole contract ? Or just the first page and the last page with signature ?
  3. Hi everyone Just wanted to say hello, after the many hours I've spent looking at specific threads for advice, and also just browsing on subjects like jobs, where to live, where to visit/holiday. I am currently in the process of gathering all the info I need to apply for a 309/100 visa. Just waiting for the stat decs from Australian friends and a couple from my friends and then I am ready to send it all in to Australia House in London. I am British and I live with my Australian partner in London. He has been here for 10 years but we are hoping to relocate to Sydney, where my partner's family live (aside from Dad in Wollongong & Mum in Adelaide - siblings are all in North/South Sydney). And most importantly, it will bring him physically closer to his daughter, also in Adelaide. I am going into the process slightly blind, but I am aware of the high taxation, higher cost of living, different medical care arrangements, so am not completely blinkered. But at the same time I am looking foward to what Australia can offer and how we can make the best of it. I visited Sydney, Melbourne, Adelaide over Xmas 12/13 and will hopefully visit again around Easter 2014, for a more practical visit - less tourist stuff and more of an eye on surburbs, jobs, transport etc. So that was a very long way of saying Hello!   4. Hi there, My husband is English, I am Australian - we have been together 3 years and married for 2. Just about to submit this application the first phase of the 309 (2 years temp) and have a few questions if anyone can help? 1. I have had most of the important docs certified by solicitor, birth certs/passports/marriage certs, bank statements etc. but not 'supporting' things like cards, photos, travel tickets, letters in both names - these are just print outs or copies - is that ok? 2. We have 12 months bank statements each - is that enough financial evidence? Do we need payslips too? if so going back how far? 3. The last 'supporting' evidence which is - Nature of your commitment to each other - we haven't been seperate for longer than 5 days in 3 years - so do we need to provide phone records? and we don't have a will, so what can I use for this?? Our personal statement covers a lot of 'background' and 'combination of affairs' - so will this suffice? Thanks in Advance anyone I'm exhausted from compiling this thing. should have got an agent to do it!

Applying for a spouse (309) visa, our progress so far.... 20/4 - sent off application (frontloaded). 21/4 - money taken 27/4 - email from C/O confirming receipt of application 29/4 - received all the evidence we'd sent back in the post 05/5 - phoned C/O who infromed they didn't require anything else but there was a backlog of apps and it could take 3 months to hear. Has anyone else who's applied in the past couple of weeks heard anything? or been granted a visa?

    hello. i have been in Australia for about 10 months now. i got married a year ago. and got my visa and came here. and after few months of being with my wife here. i found out alot about her. stuff she lied about. and she have mental issues and sucidal and she kept threatening me that she will kill herself. and i have phone recorded for that. beside she has been very mental abusive to me playing with my head. and she has been abusive to her kids from her prevues marriage . and i contacted her ex husband to find out. and i've it written from him that she has threatening him by hurting her kids if he didnt go back to her. alot of stuff. she have alot of problems , so i left her and i live on my own since. i contacted immigration and they gave me options . one of them is to apply for PR. and i did apply and i wrote them a big letter explaining everything. and that was back on feb. and i have txt masgs and call recordes and chat screenshots of her abusing me and being racist. and that she can kick me out of the country anytime she wants. and i've two members of her family supporting me and willing to write a letter to immigration to tell them how unstable she is now my questions is. whats my chances of getting the PR?
  7. I'm a complete novice to the Australian visa system (although a bit of an expert in the UK system due to husband's immigration here!) We are considering a move to Australia in 2014 to arrive approx October 2014, ie the end of next UK summer. When should I be submitting my application for a 309 visa? I had a vague idea that the visas have a kind of activation time limit ie once you are granted the visa you need to take up residence in Australia within a certain time otherwise the visa expires? I have done a quick search and couldn't find the answer but there is a lot to search through, so apologies if this question gets asked a million times. As I know from the UK system, forewarned is forearmed and the sooner I get preparing myself for the stack of forms the better. And I've read here that it takes about 8-9 months to get the visa awarded. I'm wondering if I should start thinking about submitting the application now to give us plenty of time, or if this would be a mistake because it would "run out" too soon once (fingers crossed) it gets awarded. thanks in advance if you can help me

[it is the Partner Visa: Offshore Temporary and Permanent (Subclasses 309 and 100) i am wishing to apply for] Some information so you know where i am coming from: I am british and my gf is Australian. I lived in Australia for one year on a working holiday visa. Towards the end of my year in australia we were going to apply for the Onshore De Facto visa so I could stay in the country (and my job), but as time was running out and I was getting different answers every time i rang the immigration department about having a complete application, we decided it was safer to leave on the day my visa ran out and make our way to the UK to apply there. We have been travelling through Asia since then and now we are about to head back to the UK. The plan is to apply at the immigration office when we get back to the UK. We have all the required documents (statutory declarations etc) the only thing we won't have is police clearance from Spain (as I lived in Spain for over a year in the last five years so this is required) I have read through the application form and the document checklist but my question is.. Is it possible to apply as soon as I arrive in London and then give the police clearance documents once we have been to Spain to collect them? It could be a month or two later. We really want to get back to Australia asap, but don't want to risk applying and then being declined for something like one missing document. PS the reason we are going to Spain for the police clearance is that it is 400euros more expensive to organise a lawyer to obtain it on my behalf. I must go to Madrid to collect.   9. Dear All I would just like to thank everyone for their help and advice re my offshore Second Stage Partner visa. SUCCESS!!!!!! I am now the proud owner of a PR Subclass BC100 Permanent Resident visa...yes little ol me...yeehaa! I posted paperwork to Brisbane on 8th March (approx). I telephoned Immigration yesterday (approx 45 minute wait) to check if they had actually received my paperwork as I hadn't received the acknowledgement letter back, only to get through to a lovely guy. He asked if I was near a computer and could I go online whilst he waited. So I did and logged into my VEVO account and nearly fell of the office chair. OH MY GOD!! I got it and not only had I got it, it was granted on 9 April 2013, so about a month from posting.   10. Hi all! After years of lurking in the forums and getting tips and years of complex delays (family reasons), I finally lodged my De facto Partner (100/309) application on 19/02/2013 (having completed 5 versions of the 40SP/47SP over the years on various false starts!). Following the excellent advice on this forum, I submitted a comprehensive application proving 9 years de facto relationship with my Aussie partner, showing adequate funding, including owning an apartment in Melbourne. I more than qualify for progressing straight to the 100 visa and PR. I also already have family that have emigrated to Australia (2 sisters and husbands, their grown up families etc) so we both have extensive family support networks. But the processing time for partner migration is 8-9 months at least! We sold up and moved into rented nearly a year ago, so everything is in storage ready to go. Obviously, we can wait if we have to but I wonder what other options I have? Travel on a 3m visitors visa and try to get a bridging visa? Sponsored by one of my sisters, perhaps? Any advice on options to explore would be gratefully received! After years of waiting, I just want to get cracking!
  11. Hi guys, In May 2012 I applied for the 309 spousal visa, which was granted in November 2012. In December we went to Australia for Christmas so I activated the visa at that time. My question is, what happens if we don't now move to Australia for, let's say, the foreseeable future? My wife, the Aussie, is pregnant and we are expecting an arrival in August. We are currently earmarking a February move, but I'm curious what would happen at the two year stage, when they come to review the 309 for upgrading to the full visa, 100 if memory serves, and we have not moved. I don't recall seeing anything specific about this when we did the application. Any thoughts, suggestions or links to information would be appreciated. Thanks

My partner and I have found this site extremely useful for other things, so first of all a big thank you and congratulations to anyone who's recently received their visa! My questions is regarding getting documents certified. I have photocopies of both our passports certified, and we both have certified copies of our birth certificates. Do other documents, such as tenancy agreements, utility bills, invitations, cards and any other supporting evidence have to be certified copies as well? Or can they just be colour photocopies? If anyone could please share with me their experience with this part of the application, I would really appreciate it. We are applying for a 309 de facto visa, and have lived together for approximately 22 months. We are submitting the application without an agent and are almost ready to send it off.     Defacto Relationship Requirements

    Hi All, This is my first post and have spent a fait bit of time trying to find someone in a similar situation but had no success. I guess everyone is in a unique situation. I (pom) want to go over on the 309 Visa with my Aussie girlfriend who I have been with for two years now. However we didn't move in together until 6 months ago. She bought a place and I moved in 10/2012. I am just a little confused to whether or not this disqualifies me from being able to get the 309 partner visa? I up until that point of moving in with her had been technically living with my parents, however spent nearly all my time at my partners rented accommodation. The evidence I can provide is we have been away together on holidays through the two year stat decs from 5 people in Australia (her mum, dad, sister and two friends) A joint bank account with savings going in from both of us for the last 13months Photos, letters and emails of us being together Last 6 months of bills being delivered to the same address. We both pay different house bills so no joint names. (i took car insurance, internet, tv) She took (gas, electric) I have proof in my own bank statements I sent money towards mortgage for the last 6 or 7 months So I have all form and proofs printed and ready to go, however just wanted to make this last minute plea in case anyoen had been rejected? I am under 26 so I could apply for the WHV and then apply for the defacto when I am in Australia. My only concern for this is a) employment restrictions or disadvantages with WHV visa. b) We are planning to move permanently so I would effective be lying by saying I am just taking the WHV visa then going defacto (has anybody else done this?) .. Any help and replies would be greatly appreciated Thanks you so much, Jay

    An odd partner visa question!

    Hi guys, This is our first post! Hopefully one of you super helpful and intelligent people can lend a hand! We want to apply for a Partner Visa (309) in February next year once we have enough evidence. However we really want to get married in June after we have lodged the application i.e. get married during the application process (or just after if the visa comes through quick!). Can we do this? We know we really should apply for a prospective marriage visa (300) but for cost reasons we want to avoid this as it works out a lot more. Any help you guys can give would be great! Hello all, I know this is a bit of an essay, but hoping someone can perhaps help! :biggrin: Thought I had everything planned out but have just read a doc on the immi.gov.au website that's made us a bit worried :unsure: The scenario is this; * I have been with my girlfriend (in a genuine, continuing relationship) since February 2010 * We left for Australia on a 1 year working holiday visa in April 2011 * In May 2011 (having received a positive skills assessment), I applied for PR (my partner was included) * In December 2011 (after all medicals etc had been completed), the DIAC advised that we had not satisfied the relationship requirement (as we'd only actually lived together for 10 months at the time of application), therefore my partner provided written withdrawal). * My residency was granted in March 2012 (following a trip to New Zealand, returning to Australia as a resident a few days later). * In April 2012 we both came back to UK (as my girlfriend's WHV was up and we didn't want to be apart) * The plan was then to live together here in the UK to get the extra evidence we need (which we've got now having been living together in Oz/UK for a further 14 months on top of the existing 10). My partner is English, has a degree, no kids, no criminal record and is 25 so I don't think there's any issues on that side, the question surrounds my eligibility as a sponsor... After the permanent residency visa was granted, I stayed in Australia for about 4 weeks before departing back to UK (due to partner's WHV being about to expire). We're now wanting to apply for the Partner (Temporary and Permanent) (subclass 309 and 100) visas and everything looks fine, apart from a line on P16 of the 'Partner Migration booklet'; "If you are an Australian permanent resident or eligible New Zealand citizen, you are required to be usually resident in Australia." ...nothing of this kind appears to be mentioned anywhere else. As it stands though, I am NOT usually resident in Australia (as I don't want to be without my partner!). Will I need to go to Australia alone and live there for awhile before I can sponsor her? Is there a set amount of time you have to be a resident for before you are allowed to sponsor? If anyone has any experience/advice of a similar scenario I'd be very much appreciative if you could share! Thanks in advance fellow Poms in Oz Ged (A Pom not yet in Oz!)

Hi everyone, We are due to be granted the 309 spouse visa, hopefully very soon but it's got me thinking, I know the oz govt site state that the 100 perm visa will be granted after a two year waiting period from when the visa application was submitted but is there any evidence that we should be gathering as our relationship continues? Just wondered if anyone could shed any light on how the process works? Many thanks L

Hi there, currently wading through all the material needed for an offshore defacto partner visa - it's quite stressful! :arghh: (I am applying offshore) We've had lots of friends who have offered to write statutory declarations for us but I am a bit confused as to what I should ask them to write! 1) Can they use this form or is this out of date http://www.ag.gov.au/Statutorydeclarations/Pages/Witnessingastatutorydeclaration.aspx The link to the 888 form on the partner migration booklet doesn't seem to work - does anyone have a working link? 2) What should they write? Are details of how they know us, social activities we've done together etc appropriate or are they just meant to write that they confirm that we are a real couple? Thanks for any help you can give!!!

    Hi everyone, So we've now got our case officer and I've received an email from her asking for: Joint financial or legal documents (mortgage, bank account, utility bills, wills etc) from March 2010 onwards; Individual financial or legal documents showing the same address from March 2010 onwards; Statutory declarations from friends and family. but this was all sent with our application....? Any ideas....?

    Hi There, Can anyone help? If my son already has australian citizenship, do I have to include him under question 19/ Give details of ALL of your partner's dependent family members who are included in this sponsorship....? He is named in the forms but he's not part of the sponsorship as he's already Australian? I think we're getting ourselves in a muddle here!
  21. Hi There I've just applied for subclass 100 (PR) from a Subclass 309 (provisional resident) visa. I've been living onshore for 15 months. I'm told the processing times are 6-8 months. Does anyone have any experience with this process? Did it really take that long? Cheers
  22. Hi everyone, hope all Visa lodgements are going well for you all! I applied for my Partner Subclass 309 visa back in March 2009, which was granted by June 2009 and I moved out here in July 2009, it was all fairly straightforward, we didnt hire a migration officer and I double & triple checked everything before it was sent. All that seemed to go through fine, and like I said I was on my way by July. No one seems to really tell you much information about the second stage of this visa, I was advised to contact Immigration 22months after I lodged the application, so that I could continue with the next stage, I have done that and I am waiting on the paperwork arriving, hopefully any day now. When I asked the lady on the phone what it actually is, she said just more paperwork to show that you are still together (which we are, and getting married in July!) :biggrin: Does anyone know what the paperwork is/what kind of questions? is it basically just the first process all over agian? How long does it take to come back? do you get interviewed? And is there another cost involved? Its quite confusing, as you sort of forget after being here for 2 years that you are STILL only a temporary resident! But it does present a few obstacles with things such as loans, insurance etc. Any help would be very much appreciated, sorry for the long post , thanks :wink:
  23. Hello All! - It's been a while since I last posted! My Australian partner and I have been in a de facto relationship now for over 3 years. Just over a year ago we left our flat in Australia (I was sponsored 457) and came to live in the UK (joint tenancy with another couple for 12 months). We now wish to apply for the 309 visa so that we can return to Aus with my Australian partner being my sponsor. We believe that we meet the standard eligibility criteria (finance, committed relationship etc) however we aren't sure about a few details: - Do we both need to be residing outside of Aus whilst my app is being considered? Will she be required to attend an interview with me at Australia House in London? - If we lodge our application this April and my partner returns to Aus in the interim (April onwards) will this affect our application? - This is likely to happen as my partner has potential work back in Melbourne but we are concerned that it may appear to contradict our claim to be in a de facto relationship if we will be apart for the duration of the app (we plan to meet in Asia, visits etc) Compared to many peoples troubles this may seem a little OTT and silly but we are really worried and cannot seem to get any advice from the official channels, would appreciate the help from you all!

    Stage two of 309 Spouse Visa

    Hi All, Quick question, When completing the second stage of your 309 spouse visa has anybody been asked for a 2nd UK police check. Obviously I submitted one when first applying for my visa in 2009, now the 2 year temp PR visa is ready to be converted into PR 100, Diac is asking for a Police Check for any country I have resided in for 12 months or more during the the past 2 years. As I am still in UK does this mean another UK PC. I have nothing to hide but a 2nd PC check for UK seems a little strange. Thanks Metoo
