  1. Hello, I've applied for partner visa subclass 309 to AUS. While waiting for the same, I'd visited AUS to spend time with my husband who is an AUS PR. I'd searched for jobs while my visit to AUS and have also received an offer from one of the companies. But, I can not start working until I receive my partner visa, which is under process. The company has given me the offer letter with the joining date as pending. Is it fine if I tell my case officer that I've been offered a job in AUS, which can start only after I receive my partner visa. Will this help in speeding up my case? My case is now pending for the final decision only. All documents' assessment, medical checkup, police check, etc. has been completed and the case is now with a higher case officer for the final decision. How much time should it take now? It's been 3 months already. Please help me with your answers. Thanks.

    An odd partner visa question!

Hi guys, This is our first post! Hopefully one of you super helpful and intelligent people can lend a hand! We want to apply for a Partner Visa (309) in February next year once we have enough evidence. However we really want to get married in June after we have lodged the application i.e. get married during the application process (or just after if the visa comes through quick!). Can we do this? We know we really should apply for a prospective marriage visa (300) but for cost reasons we want to avoid this as it works out a lot more. Any help you guys can give would be great! Thanks in advance! :notworthy:

    help with 309 partner visa?

hi guys, i am hoping someone can give me some answers on lodging my application for a partner visa  1. Do the statutory declarations have to be bu Australian citizens as myself and my partner do not know any? 2. We both still live with our parents as we have been saving to move, will this affect my application although we have been together 5 years? 3. Does it matter that my sponsors employment history is in the UK and therefore his letter/payslips etc are from the UK? Really hope you can help me out before I lose the will to live! Thanks :wubclub: Rachel

    309/100 medicals

Hihi, I am new here and a close friend recommended this forum as one of the very informative and updated migration forum. Indeed this is a great forum filled with lots of information and help. I am currently applying for 309/100 and would like to do medical check now. My medical centre asked me this 2 questions. 1. Are you a temporary or permanent applicant? (309 is temp while 100 is permanent; so should I consider myself temp or permanent?) 2. Please provide the address for the clinic to send the medical report to. (3 choices given: Online or send to SYDNEY or send to the LOCAL AHC where my paper application is submitted) I have inform the medical centre that I am doing spouse visa 309/100, but they are not sure about the 2 matter above. I have made a call to DIAC and DIAC said that the clinic should know all these. So now I am stuck and I am not sure where to get these answers from. I have already tried glancing through a few pages and topics of the 'migration issue' and couldn't find answers to these questions I have. If there is already a same topic, please link me to it, I might unintentionally missed it. I hope this can updates evereyone who are having the same issue lately. I hope the kind souls and migration agents in this forum can advice me. Thanks in advance. ^^
  8. Hi All, We have just submitted 47sp and 40sp for OH's 309 visa. Thanks to the advise of the forum we have now got citizenship certificates for our 2 children and are awaiting their passports. Question - We have received quotes for one way flights to Perth, but are worried that my OH might not have his 309 visa issued by the time we arrive in Perth (end of November so might be tight)! Could anyone advise us what we should do? Our concern being that immigration might not let him through without return ticket. Many Thanks Megan:biggrin:
  9. Hiya, I am currently getting all my bits and bobs together ready to apply for my partner visa and wondered if anyone had any advise on the declarations required from friends/ family. I have read lots of leaflets and threads and pages, but am still a bit confused! 1. Can these statements be made by family, or do they have to be from a non-related person? 2. Do these people have to be in/from Australia? 3. What sort of things should these declarations say? Are they just one liners saying “yes these 2 people are in a genuine relationship” or should they be similar to my husband and my personal statements and more describe how these people know us and include details about our relationship? 4. Also, do these need to be certified? 5. For any documents/copies that do need to be certified, who can do this in the UK? Thanks so much for your help! So exciting and so nerve racking, I'm a bag of good and bas nerves all the time at the mo, just at the thought of it all J Thanks, Em
  10. Hey guys so i've started to get the ball rolling with my 309 partner visa. Decided to do it ourself's and have a quick question. Just in regards to the documents needed in the Part I document checklist i am wondering what everyone included with their application. What is a "Certified copy"? We are currently in England and I "Being the Australian" need to send a certified copy of my birth certificate. The original is in Australia with my parents. Also just what people included for evidence of relationship? do i need to send in photo's, email's, things like that. Any help is greatly appreciated.

Can we forwarded them at a later date. 3/ Address where to send application? We want to send it special/recorded delivery, but i read they will not except it this way as there's know one to sign for the packages? Have I got my lines crossed? 4/ Should we start organizing our health checks and police checks now? We're based just outside London and was wondering, are there list of who to call to book the checks? Do we go to the local police station for police checks? Really appreciate any help on the above as my heads starting to hurt..hehe Kind Regards Megan:err:

    309 40SP - 2 questions

Hi All! On the 40SP form and looking at the booklet it says that the sponsor must be a permanent auatralian citizen and usually resident in Australia. My OH (who is Autralian) and I have been together for nearly 2 years and he has been in the UK for 7.5 years - Evidently we are trying to move to Oz. Can he complete this form even if he is not "normally resident" in Oz now but will be obviously when we get the green light to move over there?? Also one other quick question - I am now at the point of bundling my masterpiece of an application together - how have you all displayed the information? There's lots............... Thanks in advnace - I cannot wait to get this sent!
  13. Right, about a month after our initial deadline we're nearly read to get our application handed-in. Just waiting on the last couple of stat decs to wind their merry back through the postal system from Oz. I just wanted to make sure I don't miss anything obvious. One thing that I'm unsure about is the document certification requirements. I have previously read the following in a forum post which has been extracted from an email from DIAC: Do I send Originals or Copies of my Documents? We require originals of character clearances only. You should provide certified/notarised copies of key documents such as birth, marriage and divorce certificates. In all other cases provide simple photocopies of supporting documents such as rental agreements, bank statements, insurance documents and the like. However, this was dated 2009. Can anyone confirm that it is still OK to send non-certified copies of documents such as bank statements, bills, etc and just get the important ones certified (passports etc)? Has anyone had any problems with non-certified documents?
  14. Hi Does anyone know, if it is possible to travel over to Oz on a tourist visa whilst awaiting a spouses visa (subclass 309) to be processed. My husband has Oz citizenship and I am applying for a 309, however after reading some threads on the forum quite nervous this will take some time to come through. We plan to be move over in September, so was hoping it is possible to apply for tourist visa whilst 309 visa is being processes, is this allowed? Also what is the status with schooling without a visa, we have found a place at a private school for our daughter in Melbourne and would like to enrol her for October start. Will her visa application need to be processed before she can start school? Any advise appreciated. I am a British citizen and have applied for visa through Australia House in London, clean bill of health, no criminal record and have been married for years so anticipating it will be processed with no hitches. Thank you AC
  15. I am an Australian Citizen and the sponsor for my husband's spouse visa. We got his 309 visa granted on Feb 2010. We live in Dubai and its from here that we had applied for his Spouse PR. We had actually planned to move to Aus but we are postponing it for now. I know that around the 2 year mark DIAC will request us to resubmit documents for grant of permanent PR. I just want to confirm a few things so that we can plan our next move 1. Can we apply for Subclass 100 (Permanent Spouse PR) outside australia ? 2. I was employed until recently and now out of work - since I am his sponsor am I expected to to be working and show pr0of of employment ? 3. We used a migration agent for the first stage - so will DIAC contact them around next year ? Your inputs will be highly appreciated as we will need to move to Aus if I need to apply from there. TIA

    Partner Visa - Subclass 309 & 100

Hi, We are looking at applying for the Subclass 309 (temp) and subclass 100 (perm) visa for my partner. I believe that if my partner is successful in getting the temp 309 visa then we have to wait 2 years before the perm 100 visa will be looked into... Is this correct? Also, is it possible for us to move to australia under the temp 309 visa? Will my partner have to leave the country for the perm visa to be accpeted then?? One question: Is says on their PDF (1127.pdf) that:- 'You may, however, be granted a permanent visa without having to fulfil the usual two-year waiting period if: • at the time you apply, you have been in a partner relationship with your partner for 3 years or more, or 2 years or more if you and your partner have a dependent child of your relationship' We have been together (de-facto) for 10 years and have two daughters (aged 4 and 7 currently). Have anybody else been down this route and didn't have to wait 2 years for the perm (100) visa? If so, how did it all work and how long did you have to wait? Love to hear off someone who could clear this up for us!! EDIT: Sorry just found this information: Permanent Partner visa (subclasses 100 and 801) If you: • lodged your Partner visa application outside Australia; and • were outside Australia at the time you applied, you can be either in or outside Australia when the permanent Partner visa (subclass 100) is granted. But would love to chat to others in the same boat as us and find out any tips etc to helping us out! Thanks
  18. thanks to all the help we had off here, we were able to complete our defacto visa and lodge it ourselves without the help of an expensive migrant agent! I feel the pressure lifting slowly off the shoulders now that its all paid for and out of our hands... We front loaded the lot, police checks, medical and form 80 and lodged it this morning!, so hopefully we should get the visa approved by the 27th Oct if the DIAC do their job and get it done within the 5 months! Wish us luck and we will let know our progress! :jiggy:
  19. well we literally have all of our documentation now, we have begun trying to put it all in correct order and will go and photocopy everything this afternoon. Just wondering about our supporting documentation for our proof of our relationship... Should we go through with a highlighter and highlight our names on all the documents where we are both on it? And highlight things like, phone calls to each other on our phone bills? Does this help the CO to save time on looking through the documents to try and figure out what they are for...? This is our last question i think, then tomorrow i am going into london to see a registered migrant agent to certify our copies then lodge it on friday.... Also I think i asked the question before, but, can we just walk into Australia House in London and lodge it in person, do we have to book or do we send it off to them....??? Thanks
  20. Almost done guys, the mrs is goin for her medical tomorrow so we can front load our app. police check done aswell.... just need documents certified now... Which ones should be certified? Obviously we dont want to send anything original unless they request it because if it gets lost in the post we are back to square one. So Can we just send a photo copy of everything? And which ones should be certified? Cheers
  21. just wondering about migration agents.. Im really stressed about all this application now, so is my partner and i think we need help. We dont want to spend £1200 to get the whole thing done because we think we have just about everything ready but we need peace of mind from a professional. So i came across a company that does "Pre-File Checking", Thames Migration Aparently they can either do the whole thing for you for around £1200 or they can just check over the paperwork and certify everything... it only costs £250 I dont mind paying that, but is it worth it.... What will they check? will they tell me if i need anything else? or do they just look at what you have and make sure its all correct? Also, the same goes with our CO and the DIAC, Do they tell you what you are missing or do they just refuse you? we are really really stressed now as we want to be home by xmas and i am on a working holiday visa which expires in august and i have to jump the country to come back as a tourist, which isnt really ideal but we dont want to be apart through the process... Do we really need help or should we just send what we have? thank you all
  22. just wondering how many bank statements we have to send. ive seen people have had to send upto 18 months worth ??? i was just thinking of sending the first and last one of our joint account and a few from both our personal accounts to show we have spent money in the same places... is that ok? cheers
  23. Hi, Apologies if this question has been asked numerous times before. Can anyone please let me know the approx waiting / processing times for the 309 Spouse Visa? I need to head back to Oz for work in 3 months and want to know whether my British wife should apply now in the hope of it being approved in 3 months or for her to enter Oz as a tourist and apply in Oz. My next question is whether it is acceptable for her to enter with a one way ticket? We and our 2 (British) sons are wanting to move to Oz permanently. I am an Aussie who has lived in the UK for 10 years. Many thanks

    Blogging our way across

Hi Everybody, I just wanted to thank everybody who contributes and runs this site it is quite simply an amazing source of information. It has helped me and my fiancé immensely and as such we wanted to give a little something back. We have decided to set up a little blog of our move across the pond to Melbourne later this year. We are going to cover everything that we encounter during this move and hopefully it will help some people thinking or even making the move to Australia. We will also cover our life after moving and if indeed this is right move after all. Our blog can be found at http://somethingbeautifulthiswaycomes.blogspot.com/ We will be cross referencing a lot of stuff back to here as well to make it a little easier to find those hard to answer questions. By the way my fiance is an aussie and grew up in Melbourne for 20 odd years. So if you want have any questions please don't hesitate to ask. Cheers Tina
  25. Does anyone know what happens with a 309/100 visa is you have PR (or indeed citizenship) but are currently living in the UK? I can obviously explain why I am resident here (to be with my partner!), and explain that I have family in Aus, and give details of my recent earnings. And can even get a family member to offer AoS if needed. Does anyone know if this will be enough? Can't get a straight answer from Aus House, and don't want to put in and pay for the app if this will blow it out the water, especially when we could get a prospective marriage, then apply for the 800/820 instead. Anyone got any experience? Thank StS
