  4. It is a system error. As long as your parents have submitted biometrics they don't have to worry about the flag. I had the same issue when my parents submitted their biometrics. Their visas were granted last week.
  5. Subclass 309 is not a permanent residence visa. So you can not apply for an exemption.

  8. May I know from which country you applied from? Sometime each country has different timelines. My parents applied for the visitor visa 600 on 1st Nov 2021, and then applied for the travel exemption on 23rd Nov 2021. They received their travel exemption on 2nd Dec 2021. And today morning (3rd Dec 2021), both my parents received an RFI (request for information). The RFI is to provide a colored scanned copy of the first three pages of the passport. The request is strange since they have earlier attached a colored copy of the first two pages of the passport. I wonder why they need to see the first three pages of the passport instead of the first two pages. I have already fulfilled their request within a few hours. Hope the visa gets granted sooner than later.

If your relationship started in Aug 2017, and you have the evidence (such as pics, chats, emails, tickets etc) to prove it, it will be a good idea to request the case officer to grant you 100 visa directly. This will not only improve your chance for an early grant, but will also allow you to travel to Australia during the border restrictions, as the border restriction are not applicable to 100 visa holders (PR Visas). For this you will have to ... Upload the evidence to your immi account that proves your relationship started in 2017 August. Write a letter to the Case Officer. Self-sign the letter and upload the scanned copy of the letter to your Immi Account. In this letter you will request the case officer to directly grant you 100 visa as you meet the definition of "long term relationship". Note: As per the immigration laws, definition of "long term relationship" is that you are in a relationship for "at least 3 years" OR "at least 2 years and have dependent child" Please bear in mind, I am not a professional agent. I was an applicant just like you. I did the same and was granted 100 visa ... My friend also did the same, and his family was also granted 100 visa.
  12. How long you have been in a relationship with your husband? I am asking this because the duration of your relationship will decide whether you will get a 309 or a 100 visa. 309 is a temporary visa, while 100 is a permanent visa. Eligibility for 100 visa is that you should be in a relationship for "at least 3 years" or "at least 2 years and have a dependent child" If you are eligible for 309 visa only, then there is a very little chance you will be getting the visa this month. Because at the moment Australian borders are closed for non-PR holders and citizens. As 309 visa is a temporary (non-PR visa).
  13. There is a great misconception that applications from London are being processed quickly. It all depends on how "complete" your application is, and whether you have attached all the required docs and information with your application. My wife is from Pakistan, her visa was processed in 9 months in 2019. At that time the processing time on Immi Website was 16-22 months. Similarly my friend's visa was granted very recently in 2021. It took only 5 months. This happened during pandemic when the borders are closed. She is also from Pakistan. She is allowed to travel to Australia since she was granted 100 visa (because their relationship was long term). At the moment, the Immi Department is not issuing 600 (visitor visas). Non-PR holder and Non-citizens are not allowed in Australia due to pandemic border restrictions. There is a very strong chance your partner will not be granted 600 (Visitor visa). So, your plan for applying 820/801 onshore might not work. But on the other hand, if you apply for 309/100 visa. First thing you have to check is, if she is eligble for 100 visa. Applicants are eligble for 100 visa if they have a "long term relationship". "Long term relationship" is when you are with your partner for "3 year or more" or "2 years and have a dependent child". If your partner is eligible for 100 visa, only then you should apply for 309/100 visa. Since "100 visa" is a permanent resident visa, while 309 is a temporary resident visa. Keep in mind, if a 100-visa is granted to your wife, she will become permanent resident of Australia, and even she is outside Australia, she will be then allowed to travel to Australia. As borders are open only for Permanent residents and Citizens. I hope this answers all your questions
  14. Yes, you can sponsor your wife and kid even though you have not lived in Australia for the last 3.5 years. I can tell you this with 100% confidence because I did the same. I received PR visa in 2014. I visited Australia in 2014 for a few days to activate my visa and then returned back to Pakistan. Then in 2019 (after almost 4.5 years ) I applied for my wife and son's visa (309/100) while I was in Pakistan. After applying for my wife and son's visa I stayed in pakistan for 6 more months, as I knew it will take almost 12-15 months to process the visa application of my wife and son. And then after 6 months of applying my wife and son's visa I moved to Australia. Both my wife and son received 100 visa (which is PR visa). Please be noted, one of the requirement to sponor 309/100 visa is that the sponsor must be a "usual resident" of Australia. Interestingly, no where in the immigration constitution the term "usual resident" is defined. It is open to interpertation. So sponsor's "intention" to reside in Australia is enough to qualify him as a "usual resident".

  16. There is no technical difference between "visit" and "lived". I used to travel to UAE a lot for client meetings. The duration of these visits accumulated to more than 12 months. So, I was asked by the homeaffairs to provide the Police Certificate from the UAE even though my nature of travel was only visits (and I never lived there). In my case, the home affair even asked me to provide Police Certificates from all the countries where I stayed for more than 2 months (instead of 12 months). Which I believe was a typo error, but I still provided them all the PCC, and fullfilled their request. I got the visa in 9 months

  18. Since HomeAffairs has announced they are expediting the 309/100 visas. Please make sure your application is decision-ready so that it is processed quickly. It is not a professional advice. Based on my personal experience if you submit the following docs your application gets processed very quickly. My visa application was processed in 9 months. and my friend who also submitted the same docs, his visa was processed in 5 months only (that too during the pandemic).   19. One of my very close friend has received 309/100 visa for his wife and three kids. He applied in October 2020, and has recieved all the visas in less than 5 months. His wife and three kids were in Pakistan when he lodged the application. He himself was in Australia at the time of lodgment. All the applicants has recieved 100 visa directly.
  20. May I ask where did you applied from. I applied in March 2019 from Pakistan and was granted visa on Dec 2019.
  21. My wife and infant son both got PR visas (100). Wife was primary applicant and son was secondary applicant. I have been married for more than 5 years, this is the main reason they got PR visas instead of TR visa.
  22. Definitly add baby on 309 visa application as a secondary applicant. This is the fastest way. I applied for my wife 390/100 visa and I added my son (6 months old) as a secondary applicant.
  23. Has the applicant done his/her medical. Ideally medicals should be completed upfront right after submitting the application, we did the same. If you are handling your application without agent, you can book your medical yourself. If your agent is doing it on your behalf ask the agent to arrange medicals for you and your daughter. My son was also 3 months old and medical examiniation was performed on him.
