  2. Hi everyone, can anybody help or give me some suggestions? My nomination got refused on 25/07/2019. Nomination applied 28/10/2016, visa applied 01/11/2016. In 2017 one of the stuffs in my working place sue my boss to the fair work,because unfair dismissal and under payment. My boss got penalty. In 01/03/2019,my boss received a bar from the immigration. The immigration bar the sponsorship from sponsoring more people until 01/09/2020. My boss told me this bar on 13/03/2019. After that the boss also told me that he stoped the service with the agent. I was worried a lot. I asked many agents about this. But my boss said if I cannot find a lawyer they won’t continue help me because they don’t trust any agents. That time was already weekends,only one lawyer agent answered my phone located in Sydney named Agape Henry Crux. The lawyer named Jason answered my phone and analyzed my case in 16/03/2019 and said I have a big chance to win my case,they sign a contract with me. I paid them $7800 including gst. And the lawyer team did submission about the bar to the immigration and take carriage with my case and told the immigration I have changed to this agent. In May,I didn’t get any news from immigration and worried a lot. So I asked my lawyer team if they can write a complaint to the immigration. The lawyer team replied me that because this is an additional instructions and I need to pay $1000 (plus Gst). I think it’s really unfair for me and argue with me. I signed the contract said they will help me with case and this is a part of my case. I didn’t pay them any more money and I wrote the complaint to the immigration by myself. The lawyer team said my case is very urgent and they said they helped me a lot so that’s why charge so much for me. But the immigration refused the nomination because my boss bad record. The fact proved that what my lawyer did does not work at all. Before this,I asked my lawyer if my case fail,do you refund me? They said if it is their fault yes,if not no. After I received the refusal letter from immigration and asked the lawyer team if they can return part is my fee,they said they don’t pay the result fee. I showed them the screenshots to show that they promised me before if it is their fault they will refund me. Today this morning they replied me and said ‘We will be informing the Department of Home Affairs that we can no longer act for you. I trust that 7 days will be adequate time for you to seek a different lawyer.’ I don’t want to look for any agents now. But I don’t know how I can let the immigration know my situation and contact me directly. Can anybody help me to figure out what I can do. I will really appreciate it is you can give me some suggestions. Thank you very much for everyone.

  4. Maybe you can give them a call and ask if they received your email or not. Normally they are required to reply you email at least in my opinion. Good luck

  8. Hi everyone, does anybody have any ideas about the processing time? My situation is that the immigration ask my lawyer if we will do explanation for the bar or not within two weeks, actually we already done it before that ask. But after that, no any updates almost 3 weeks.

  10. Sorry to hear that, you should report this lawyer. The lawyer should know know what to upload. By the way, what’s RPL?

After that I received an email from immigration saying that they have allocated a decision maker for my application. Because of my complicated situation, I changed agents. Two weeks ago, the previous agent received an email from immigration reminding if we will explain the ‘bar’. The new agent said that’s not my decision maker, if she was, she should know I have already changed the agents. They won’t be that stupid. But my boss and the previous agent both thought that was my decision maker. But both the two agents wrote to the immigration about this. Almost 3 weeks passed, I haven’t heard anything from immigration, very stressful. Do you guys have any ideas about the processing time? Sincerely thanks for anyone who can give me some suggestions. I come from 187 forum. Someone on 187 forum said that someone here has the similar situation with me. But I can’t find it anywhere. Could anyone please reply to me about this? Thank you very much!

  13. Hi everyone, I made complain to the Migration. I got reply said that they have allocated my application to a decision maker. It’s already two weeks now. I haven’t received any mews. Do you guys have any ideas when my file is opened? Or at least when they will read my nomination? Very stressful!

  15. Hi mnt, Does your boss run the business all the time? 14 months is quite a long time. I think most boss won’t wait that long.
  16. Why you can’t complain? You can follow the steps to do what you want to complain. After I made the complaint, I got reply to confirm they have received my complaint within two days and said they will reply to me within 15 working days. I made complaint on evening Friday, after weekends the Tuesday I got the confirmation email, after that one week later the following Monday I got the reply. Does it make sense to you?
  17. Hi everyone, I got a reply from immigration yesterday, but I don’t know what to reply back. Or do I need to reply? Or can I ask back how long it usually takes for an application to be processed after it is allocated to some decision maker? I’m very stressful and worried that I need to wait again without any time permit. Can you give me some suggestions. Thank you very much! The following is the reply email from the immigration. “Applications are assessed on a case by case basis. Some individual circumstances may cause applications to fall outside the published processing times. As a network we seek to ensure all cases outside service standard are only undecided because they are the subject of appropriate and necessary ongoing processing. However, please be assured that I have progressed your application with the allocation of a decision maker. It will processed as quickly as possible. The decision maker will be in contact with you or your nominated authorised recipient should they require any further information.”

The decision maker will be in contact with you or your nominated authorised recipient should they require any further information.’ I got this reply, but I’m not sure how long does it usually take after my application is allocated to a decision maker. they just say decision make will deal with my case, just very stressful and worried. And also don’t know what to reply.

  20. Hi dam, do you mean that you got police check after they replied your complaint? So is it one week later to request your police check after they replied your complaint?
