Hi, after being in the UK for 12 years, I'm now looking to return to Perth (i have dual citizenship) and having to apply now to the courts for the removal of the children from the jurisdiction. I am hoping to get the F1 form as my soon to be ex husband has not engaged for mediation to resolve this. He has alcohol dependency and mental health problems and probably would have argued no anyway. my children are eligible for australian citizenship by decent and then australian passports. I have got my 5 year old into a school where she can start next february, family child care support for my 2 year old, going back to live with my mum and have better job prospects for my self over there. My family and friend network is strong over there and it is in the best interests of the children that we go back. Has anyone gone through anything similar to apply for this order and especially where the other parent (respondent) has addiction/mental health problems? how long does it take? I have a solicitor for the divorce but was advised by another solicitor that I could apply for this on my own as have more going for me in this case. thx
