Redundancy on 857 visa - Help

Hi All, Thanks for the responses. wrussell, my girlfriend is de facto on my visa and that is why she was worried. Pity you are not in Brisbane or I could visit you. I have seen a few responses in old (2010) posts about not contacting DIAC but I was unsure of why not to contact them. The employer will not contact DIAC as he is the one making the redundancies so I think I am ok to find work elsewhere. Only question is if/when I move to another employer, do I tell them I am a permanent resident and not mention the 2year regional restriction or does that cease now that my employer has broken his contract? I assume that I still have to stay regional in relation to working? Thanks again for your replies, much appreciated. Paul

Hi V,

Thanks for that info. I may be getting made redundant as the company has had a change in management and want to go down a different route for the future so this may work in my favour and I can get out of this s**thole. Its not good when you dread going to work seeing as it has to be done every week for most of your life!!unless you win the oz lotto!!lol funny thing is half the staff hate the place and they are locals!and one of them is the boss's sister!!

Redundancy on 857 visa - Help

Hi All, Due to change of direction of the company I work at, there is a possibility I may be made redundant. Can anyone tell me where i stand with my visa and work rights? Can I get another job in the area whether it is related to the skill I was sponsored for or not? I have been working here 1 year and 8 months, 6 of which have been under the 857 visa. We have settled here and my girlfriend is a director of a child care centre but the visa is in my name so if anything happens obviously she will lose her work rights too! If anyone has gone through this before I would be very grateful if you could share your experience. If anyone knows of a good migration agent to talk to in the brisbane/sunshine coast area it would be appreciated if you could pass on their details. Thanks in advance. Paul
  4.

Hi Paul, It is all quite cloak and dagger as DIAC prolly have a hush policy on the process. Advice from them was pretty much "suck it and see". My personal circumstances were that the employers were bullies and the environment + situation drove me to ill-health. Employers notified DIAC same day as resignation (damn that felt good), DIAC informed me of intent to cancel visa in 2 - 3 weeks with 4 weeks to respond. I responded & got a positive decision within a few days. Honestly it is not something to take lightly but given the choice of life and death - I choose life whether it be in Australia or anywhere else. =) V.

  5.

Hi Vagabond, could you also tell me you story in regard to the process? Where there any special circumstances? Thanks.

    857 Visa.......DONE!! great times...

Hey, We were given a list of possible ways to show evidence of our relationship. I think this is a standard thing that is sent to you by the CO. We included the following; - Rental documents from the UK with both our names on - Letters to our current address - Statutory declarations from both of us regarding our relationship and where we see it going - Statutory declarations from friends and family - Professionals ie Accountant, Lawyer. We are lucky that we have friends who hold these jobs! - Photos covering the duration of the relationship - Flight bookings over the duration of the relationship where we had flown together - Emails Thats as much as I can remember off hand. Hope it helps.

    857 Visa.......DONE!! great times...

Hi Juls, I originally came to Oz on a working holiday visa 417. I found my current employer after a month and they sponsored me for my 857. I do not know about the 457 requirements before applying for an 857! sorry. Good luck with it all though. Paul

Hi Convict, The additional info was about my defacto relationship. We had to prove that we were in one! easily done so not a big problem.

    857 Visa.......DONE!! great times...

Thank you. The extra info was about my defacto relationship. They wanted evidence that we are in a relationship and that we see it lasting. I loaded my application with all the required doc's in the hope that I would not have to supply any more info. It happened really quickly once we got a CO. Good luck with your app's.

Hi pinkcera, I am a Construction Estimator and have been working on the Sunshine Coast for the last 14 Months. I will be staying here of course for as long as I can as it is amazing here. They asked for documentary evidence of my relationship with my girlfriend of 4 years, more information regarding her residential history pre 2007 (why I do not know!!) and Australian Federal Police checks. I don't know why they want this either! Have to get in contact with my CO to clarify. Good luck all with your applications. Paul

Morning All, Have there been any RSMS visa's granted in the last few weeks that anyone knows of? It has been 5 Months and 2 weeks since my fee was taken from my account but I cannot get an answer about the current status of my app. Have any of you been told it could take 7/8 months due to hold ups in Parramatta? I think the girl just said that so I wouldn't ask her questions she could not answer! Any advice on what to do now or should I just wait for another 2 months?? Thanks Paul
