hi tracy and co,

well i know how your feeling too, i must say however you should feel VERY confident in gaining a court order as i would in your shoes, the fact that your OH is an oz is a bonus! also if you are married with more kiddies between you and OH then its not just some fling... your son is only 7 so he needs his mummy more than wonderful daddy maybe he doe'snt realise it but like our 12 year old he will defend dad because he is the greatest and my son is made to feel guilty for not being with him or his half sister so what dad wants is more important like your ex my ex is lazy when it comes to seeing boys(older one rarely goes with now) only now this has all started with "oz thing" that he has made the effort to take him to park and start seeing family that he is always rowing with, when few weeks ago he would'nt even watch his son play football for his team on a sunday when he brings him home as its "too cold" he would just drive off! will stop my ranting now. i will be c******g it when it comes to court time so you are not alone and you have massive benefits in your case, i shall let you know how things go likewise hope to hear how yours is going, plod on....

Congrats on taking your first step towards your court order! You are more gutsy than me. I have only mentioned my plans to an aunt who I have sworn to keep it a secret. She has wished me all the luck in the world which was brilliant news. Can't believe that it is going to take 8 months for your order, do you have difficult case or does it take that long normally? I thought that it would be quicker than that. I had read on PIO that a court order to leave to UK with their children was granted on the first court date? Sorry if I am asking a lot of questions and being a bit thick but can someone not just hire a barrister and not a solicitor??

We have our flights booked to oz and now I am so excited, my son can't wait but he is already upset about not seeing his Dad for so long. My son also suffers from "sun shines out of dad's ar$e" sydrome. But I can't say that he is a bad dad when it comes to our son he sees him regular and is always there for him, thats all I ask.

Where are you thinking of emigrating to? I have set my heart on Western Oz - probably Perth, it looks beautiful. I have also hired a VW Camper to do some touring, which is going to be so much fun.

Hi Jane, thanks very much for your response, it's good to know that there are others going through orabout to go through what we are. I know when i think about it rationally we do have a pretty good case its just the thought of going through court again (he took me to court when we first separated - made allegations about Geoff 'causing bruising' on Jake - totally untrue - you show me a 5 yr old boy who hasn't got bruising!!!! Dad wanted custody said I was unfit mother and all sorts of rubbish. thankfully CAFCASS and the judge saw through all the cr*p and awarded us residency and his dad ended up with less access than he had before we went to court - his choice, not something we pushed for but showed exactly his motives for going to court were for himself to 'get back' at us). That said the uncertainty is still enough to bring all those thoughts back and that is what is scary!

We are off to Melbourne on our recci and that is where we are hoping to settle when we get over there. Its cost us about £3400 for flights, its been a long slog saving the money - but we are nearly there. We are in a fortunate position that we have family to stay with so other than our spending money we don't have accomodation costs to find on top of the flights.

Geoff is from Melbourne and he has 2 sons over there who live with their mum so it will be nice to have all of our children together. His mum lives in Phillip Island (about an hour out of Melbourne) so we will be spending time there with her as well.

Look forward to hearing how you go on and any pointers or tips you can give!!
