Unhappy perfect except for criminal record...help!!!!

Hi...please could anyone help??. We are just starting the process of applying for a skilled visa. We meet all the criteria with no probs, except....my partner 16 years ago served 6 months of a 12 month sentence for a driving offence. We live in a small town and he was just 20 years old and the local police decided to make an example of him for all the other lads out racing around in their cars.
He has had no other trouble with the police and he is now 37. It seems such a shame if the answer will be a no for that.
So really what im asking is, have you, or anyone you have heard about managed to get a visa with a similar problem????.
Please if you can give me any advice I would appreciate it. Feel really down and even if the answer isn't good, it will at least give me some closure. My family and I really want to move and don't mind the money and extensive waiting if the outcome could be positive. thanks xxxx

Get an agent they'll put you right. But I think you'll be ok. I have heard of people getting in with a record.

Apparantly thats all you needed 200 years ago

I agree with John ,id call an agent ,the only worrying thing is the prison sentance ,if it had been a slapped wrist id have said nah youll be fine,but as i say im not too sure but an agent should have a good idea,good luck with everything and keep us informed

From watching too much Border Security, I would think that you are going to be OK just be sure that you declare it whenever anyone asks you - like on the card you fill in to enter the country for example. It appears that most people get pinged for not declaring it rather than the actual crime itself. It also appears that they are most concerned about recent and serious criminal behaviour not a driving charge half a lifetime ago. Check with the agents but I would guess the balance would be in your favour.

I agree with everyone contact an Agent because you need to know before you spend any money. I was led to believe if you have a served a prison sentance then there was no chance. But I could be wrong and for your sake I hope I am.

In my past I haven't excatly been an angel!! I was told by my agent that the DIAC would look at cases individualy and are more interested in the last 5 years or so, I have a cousin who applied a few years back and did very well till the police checks, then to be knocked back due to 3 years inside for ABH (shame really cos he's a crackin lad who could have done a lot over there, but paid for his mistakes that he made in his youth). So i think a custodial sentense for a driving offense a long time ago won't really affect your application. Hopes this helps, and the very best of luck.

I think (but don't know) that the custodial sentence will be looked at a little more closely because it was a 12 month sentence, but I don't think that it will exclude you. As Quoll said, they seem to be more annoyed if things aren't declared. Can you get some people to do some character references, also your hubby could do a stat declaration regarding this and how he's never been in trouble since.

Cheers for the advice. Have heard about stat declaration quite a bit. Forgive my ignorance but what exactly is that?.
