I'm hoping that someone wil be able to offer me some advice! I've been divorced for 8yrs now and have been with my finance for 5 yrs. I have 2 kids, 13yrs old and 10yrs old. We've been talking about moving to australia on and off or a yr now and have finally decided that we wil start the ball rolling this year. One of my many questions is that my ex husband will not want the children to leave. He lives a good four hours drive away at the mo and only see's them 4 or 5 time's a year. I totally understand why he wouldnt want them to go and I do appreciate that he won't see much of them at all. I know it isnt good for me to take them away, but i really feel that we will be able to make a great life for all of us and we're desperate to go. But, I think i've seen somewhere that if he doesnt agree to us taking them (in writing) that I cant. Is this right?
Any advice would be greatly appreciated!

i have no experience of this situation myself ,but after many hours on here i have seen this topic crop up and yes you do need written permission off the biological father.If he dosnt see them that much anyway you never know he may say yes ,after its for a better life for them too and with email and webcams he would probably see them more he may well see it as a cheap hol to Oz when he visits ,,dont give up

Hi like Cal, have seen this crop up before. It may be worth doing a search on this site (it's on the tool bar uder the PIO logo) and you may be able to find some of the answers.
It also may be worth coming up with something regarding access which you present to your ex e.g. that they'll come over for hols certain times of the year etc., or that he won't have to pay any support if they live in Australia

Thanks very much for your replies. I'll explainto my ex how much better the kids lifes will be out in Austarlia and try and agree visits. Not paying any support would also help, so i'll try these routes. Thanks very much for you advice, I've been reading all the posts on the site for a few days before i wrote my own and i've seen how friendly and helpful everyone is. Thanks again

I am divorced with kids. We had to apply to the Courts to remove the children from the juristiction. This has now been granted and we have a court order.
If the children reside with you, then it shouldn't be a problem - the only condition that we made was that there would be resonable contact etc - plus if he wanted to come and see them, he could. They will keep in touch via email, web-cam,phone etc.
It is hard for the other parent staying behind, but if he doesn't agree, it's not the end of the matter. You can apply to the Courts - give them a call and see what they say. I used a solicitor for the first part - letters etc. but after £500 bill, I found that I could represent my case without help.

Now I only have to worry about the family pets and the huntsman's.... oh dear!
