MOC migration medical reffral

hi there,

i received a reffral letter from the MOC (Medical Officer of the Commonwealth ) to have the further information and report (form 884) from the specialist after my partner had her medical done on 1 march 2016. she is diagnose with Rheumatoid Arthritis. she is under priscription medication ( sulfasalazine and Methotrexate). she need to have blood test after every 3 months and specialist appointment twice in year. she is in stable condition now after we found the symptoms 1.5 year ago. MOC asked for report addressing history, diagnosis, treatment ( including the need for immunomodulating therapy/ surgery) and prognoisis for the next 5-10 year.can someone with the simmilar situation or medical reffral by MOC tell me what will happen next? what MOC going to check from the specialist report? how long it will take to have the medical approved from MOC? please we need an advice if anyone been through this before.

What will happen next is that you will get the report done by your medical practitioner. This will answer the questions required by the Medical Officer.

The information will be used to calculate cost of likely future treatment required.

can you suggest me how much minimum cost we need to have to clear the medical? she is only having the blood test, specialist appointment and medication. as from our previous record, we estimate the annual expenses on her treatment is around $2000.

The health referral takes into account everything associated with administering healthcare, not just the cost of the simple stuff like check-ups and medication.

Having said that, I'd be surprised if you have any problems. They are really looking for major issues with a seriously heavy ongoing cost to the taxpayer.

yes we received the information from MOC to get the form 884 filled out through our specialist. we had an appointment straight away after that. Our specialist provide the report that my partner's health was in stable condition n she had no problem to do daily tasks. we got our PR on 20 may 2016. if MOC asked you to do the form 884, you simply have to make an appointment with your specialist. your specialist should already have form 884 and he knows what to do. he need to provide the information of your RA to immigration like,

recent blood test report result

your joints condition

your RA stage

able to perform daily task like driving, cooking, taking shower, tie pony tail

your current medication with cost/year

you specialist appointment cost per year

possibility if you need to have a joint surgery or to put your treatment to next stage in the next 5 to 10 year

than the MOC will use this information to estimate the total cost of your treatment for the next 5 to 10 year and compare against the average Australian medical threshold. if its below that cost, you all good.

unless you are on an expensive treatment like Humira, you will be fine. Immgration only want to check if your treatment cost will put the burden on the free medicare services in future.

Thank you soo much for quick reply! Went on Humira almost a year ago ? It's stable and amazing but I know the cost might be an issue. Have they told you guys specifically it wouldn't have been approved? My specialist have helped previous clients to overrule decisions so I hope it will be ok ?. Thank you soo much for sharing as I can't find any recent information reg MOC times or my condition inregards to aust visa. So 2-3 months from submitting to MOC until visa was approved?

your immigration officer only need an opinion of the MOC. once its positive, visa approved unless there are any other issues. The immigration officer will follow the clause under migration act. You can check online migration health requirement. Go through the clauses n you will have an idea what you need to do. Yes, you can challenge the MOC decision if it’s against you. There are some case studies online where people manage to get the visa approval under serious medical conditions. Even you can check the threads and post on this site regarding HUmira and how it effects visa processing.

I did a lot of research because Australian immigration health requirements are very strict. I guess you know the rule if you have a family "one fail, all fail". The Australian immigration system has very strict health requirements for all people applying for permanent residence, designed to minimise costs to Australia’s health care and welfare system. More visa refused on medical grounds than any other scenario. So what I recommend is as you are on humira , don’t be scared n take migration advice from any reputed lawyer expert in these cases. thank you soo much! I have tried to find and read different bits of information all day. Seems some swop medication during their visa application period and then go back to humira, so silly tho that such thing should be nessesary.

I do know the family policy, so my partner will have to suffer if they fail me which hurts even more. So happy for all the info you have shared, I will get in contact with my doctor and see if maybe I can go back on mtx and prenisolone for a few months as in all cases I have foud today they ave been granted.

The applicant has been assessed against Public Interest Criterion (PIC) 4005 [see attached
extract] for the period of a permanent stay in Australia.
The applicant does not satisfy sub-subparagraph PIC 4005(1)(c)(ii)(A) in Schedule 4 to the
Migration Regulations.
The applicant is a 3 year old person with:
- Severe developmental delay.
..Form and severity of the applicant's condition: the applicant has severe global developmental
delay, on the background of microcephaly, cortical dysplasia, and a metabolic disorder.
Provision of services to a hypothetical person in Australia, with the same condition as the
applicant at the same severity: a hypothetical person in Australia, with the same condition
as the applicant of the same severity would be likely to require early intervention, special
education and community support services. This condition is likely to be Stable.

I consider that a hypothetical person with this disease or condition, at the same severity as
the applicant, would be likely to require health care or community services during the period
specified above.
These services would be likely to include:

Here they hv mentioned cost of services are high but the cost of this treatment is approx 2500 - 2700 AUD  in India. Pls advc what i shud do.

It doesn't matter what the cost of treatment is in your country.

If the medical officer's view is as above, then you may (potentially) have recourse to challenge further; however, it would be wise to engage with a registered migration agent to see if that would be worthwhile (or feasible).

Ok ...thnx . I dunno wanna challenge anyone regarding cost. All i wanna know is there any way to get thru this visa process and pls can u advc any migration agent who is specialist in these kind of cases.

There have been recent (favourable) changes to health assessments including assessing costs over a maximum of 10 years, no longer lifetime costs, and and an increase in the costs allowed. May I suggest that you review these changes ?
