debts in uk
hi we were wondering what happens to any bank loans and any other debt you have in uk when you finally get to oz if you stop paying them off do they chase you as some people say they do and some say they dont any advice is much apprieciated cheers paul

as far as im aware .....they can chase you but cant enforce anything ...this is with personal debt ...however if you owe the govenment ie tax bill they can enforce it ....better to at least pay of some of your debt here and agree a sum to pay from over there ...if you have to come back to stay in uk unless its over 6 years they can still claim back the debt

Just a wee word of warning. The threads on debts generally become quite heated and ofter get closed down. However Mrs Keily is correct, this has been discussed to death and only debts to the Govt can be enforced in Oz. I am not giving an opinion as to whether or not this is moral, but I am sure that you will find plenty who will.

Here are the facts on debt in the UK if you leave for Australia.
There is a convention called recognition and enforcement in civil and commercial matters which enables other countries to enforce the debt from the UK in their country or state. Australia is not party to that convention. Service in Australia is allowed, i.e a letter can be handed to you but it is only handed to you on the basis that it cannot be enforced in Australia on a resident, you are deemed a resident if you have lived in Austalia for 3 months or more or have significant ties, but can be enforced on any assets in the UK and only in a UK court.

something new i learned last month is that any debt you have in the uk can be connected to any asset you have in the uk so if your renting a house for instance the credit card companies and banks can go to court to have it connected to your house even though they are meant to be unsecured debt so be careful and as a few people seem to come back with in 2 years never mind 6 you could be storing up big problems for yourself if you are one of these that return and im sure we all think we will never come back but some off us will

I would like to know if peeps have gone with ccj's do they still chase you for these in oz:)))

youve got to get here first are they not a legal judgement which must be declarewd on your visa application

Don't know we havn't any at the mo just wondering if peeps have gone with them and what they did regards to payment or non payment.
Just a general question. Were already at the end of our application just waiting for our case officer now.
