      Im on Aussie, what issues will we have getting my woman's Visa?

      Hey guys, this is the situation.. My girl came here on a tourist visa (3 month) and extended it. She doesnt have a 'no further stay' though. We are planning to apply for the partner de facto visa.

      A few things, I'm wondering how/if these will affect our application:

      > She cant get a police check in time before applying (is this critical to submit with the initial application?)

      >She is 18, I am 20, and as I have been overseas for a long time I dont have a job at the moment. Is it okay to use one of my family members as the sponsor?

      > Once she applies for the defacto partner visa, will she be allowed to stay here 'in status' until her visa is either allower or denied?

      You need to be living together for at least a year before she can apply for a partner visa, and you also need evidence of living together. No one else can sponsor her. Even if she applies for a partner visa, once her current visa runs out I think she'll have to return home until if/when the visa is granted.
      If she's not eligable for a partner visa I suggest she goes out of the country, New Zealand will do, applies for a working holiday visa (you have to be offshore when applying and offshore at time of it being granted - it doesn't take long) .
      She also has to have a minimum of $5000 though, plus it's a couple of hundred dollars for the visa fee. If she can't get a partner visa but can get a working holiday visa it allows her to work and holiday for up to 12 months.
      If she does regional work in some parts of australia for 3+ months. I.e fruit picking in WA or NT and some selected areas of other states then she might be eligable for a second working holiday visa, which again allows her to stay for another 12 months. During this time you could live together and get sufficient time and proof of living together and then maybe see if you can apply for a partner visa after.
      I can't tell you how likely it is that that plan would work but at least she would have a further 12-24 months with you, or alternatively if you're able to you could go back home with her and live together for 12-18 months and then apply for a partner visa.

      So she cant stay while the visa is being processed? The process can take over 6 months, how is a person supposed to apply here and wait in out 'in status',

      We have already lived together for 12 months and have plenty of evidense of our relationship, so thats not a problem.

      You're better off giving them a call (there should be a number on the website) to ask if your partner can or can't stay whilst the visa is being granted (when her tourist visa runs out). I'm not 100% sure. Someone else on here may come along to confirm or correct me, but better off getting all the facts from them.

      Are you sure there are no alternatives to me sponsoring her? I have a number of willing sponsors in my family.. but I don't work. Would this definitely mean our application will not be accepted? I have been searching their site for a number but cant find one.

      You and/or your partner will have to pay for that visa, by the way, I'm not sure how much it costs. If you're not working that could be tricky. Your family can't sponsor, only family of her own could if she has any living out there.

      Whats the minimum I would have to make to be an acceptable sponsor? If I quickly started working with my old work again would that count? Is there any chance of getting through this application if I am not working?

      We can pay for the visa, I know its $2,500. Actually being supported is not a problem and we live fine, its just that I need to get thru the paperwork acceptably. Thanks for responding.

      You're asking for specialist advice which most of our membership isn't able to give ... perhaps talking to a qualified migration agent or the immigration dept would be of most assistance to you. With some visas, bridging visas are granted whilst on shore applications are processed - I don't know if the visa you hope to apply for is one of these.

      When we applied..I was a part time worker not earning much and also had no job to come to here in Australia...Hubby was main earner..but we got ours. If you get a job now It will probably be ok. But as Ali says sounds like you need some more professional help than most of the members on here could give.

      Hi as far as I am aware your partner WILL be granted a bridging visa whilst her application is processed. This would allow her to stay in Australia. I am not sure if she will be able to work on the bridging visa though. You do not need to be working to apply however there is a likelihood that if you have no job you will be asked to supply an assurance of support. This is a large lump sum amount that is held in trust for 2 years.
