      Can I swap my visa to another one one application in please HELP!

      Hi All

      I hope you can help me. I have been sponsored on a 121 ENS visa, but due to health problems there has been a delay in the processing of my application. Now my Nominee is only giving me 4 weeks to commence work, which is impossible as I have not even been allocated a case officer yet.
      I was wondering if anyone knows if immigration will let me swap to a skilled independent visa 175 off shore. As I have already paid the fee for the 121 visa, and do not want to waste that money. I am a registered nurse with 3 year post grad work experience.
      I am applying through Perth Centre of Excellence.

      No - you would have to make a new application and pay a new fee.

      Why are your employers making this demand? How soon would you be able to start work in Oz? 6 weeks' time? 8 weeks' time?

      I think I spoke to you some months back. I am the one that had the brain anuerysm.

      They sent me a letter yesterday stating that due to the current economic climate, the number of skilled positions being offered within the Australian labour market is decreasing. They say that the current staffing levels at Royal Perth Hospital is at an exceptable level and any shortfall is able to be replenished by the current local workforce.

      What I did not understand was that they said that my start date was 20/11/08, this was the date they sent the contract to me, as my interview was only on the 23/10/08, and I did not even get conformation of the nomination approval until Jan 09. So did they expect me to get a visa application in and approved 28 days after my interview??

      Even when I was unwell I informed them of my circumstances, and keep them updated on a regular basis.

      They state that as the date (20/11/08) has lapsed, and I did not commence work, they would offer me a new start date to commence in 4 weeks time, and if I am unable to meet the conditions by this date, the offer will be withdrawn and the nomination cancelled.

      I am unable to say when I could start work as I am waiting for medical test results then I can take my medical. My application went in june and DIAC said it could take 5-7 months.

      I dont know what to do now I have worked so hard to get this far, I'm gutted. I worked out I would have 140 point if I went for the 175 visa.

      Thanks for your reply any advice would be greatly appreciated.

      Several other of our readers are nurses and several of them have reported similar reactions from hospitals in Perth recently.

      Particularly in view of your recent medical history, I'd take the whole thing at a much slower pace if I were you and I would gear up for skilled independent migration (GSM)instead. I wouldn't migrate under an employer's umbrella if I could do it under my own steam because I like to be in charge of what I do and when I do it.

      Two of the GSM visas are potentially of interest to you, being the 175 and the State sponsored 176.

      Visa Options – Professionals and other Skilled Migrants – Workers – Visas & Immigration

      Australian General Skilled Migration Booklet

      With either of these, you need to prove recent work experience:

      To meet the recent work experience requirement, you must demonstrate that you have been employed:
      • in an occupation listed on the Skilled Occupation List (SOL)
      • for at least 20 hours a week
      • in a paid position
      • for at least 12 of the 24 months immediately before lodging your visa application.
      You have had a break this year because you have been ill but (a) that might not matter; and (b) even if it does you can probably prove 12 out of the last 24 months anyway?

      If you opt for a 175 then you will rely on the Critical Skills List to give you visa processing priority with DIAC:

      I assume that you already have a positive pre-migration skills assessment from the ANMC but please confirm?

      The most significant recent change for you is that DIAC and the ANMC between them now require all nurses to prove Proficient English and Nurses have to do the Academic version of the IELTS. See the link above and the ANMC website.

      If you already had ANMC approval before the new IELTS requirement was introduced, you might not have to bother with the IELTS but you would need to check that with both the ANMC and with DIAC.

      So what is the score with the skills assessment, please? Also, how old are you, please?

      Hi Angie

      I think - think - that you are lucky and will not have to do the IELTS but I would suggest checking both with the ANMC and with DIAC. The relevant DIAC visa processing office is the Adelaide Skilled Processing Centre (ASPC.) You can send them a pre-lodgement enquiry:

      I'd use the form to e-mail them so that you have written advice from them.

      You have 125 points, I reckon, if you apply for a subclass 175 and use the CSL to give you processing priority. I've also *heard* on the grapevine that WA State Migration Centre have been giving Nurses priority processing with State sponsorship applications and at one point Nurses were getting their State Sponsorships within about a month instead of around 4-5 months for most other people.

      Time wise there is almost nothing in it whichever way you do it and you don't want too much of a rush because of the meds angle. Therefore I'd be inclined to submit an application for an sc 175 visa and then sit back and wait till your meds are requested.
