Business visa

Hello

My family and I are considering moving to Perth.

I am one of three partners who have run a successful call centre business in the UK for the past ten years employing over 200 people and turning over £5 million pa. Last September we sold a 76% majority stake.

I believe the only visa I could use to obtain entry is a business visa. My question is has anyone any experience in obtaining the visa through there own merits or is it advisable to use one of the many visa specialists and pay them £4000 to do it for you?

Any comments would be much appreciated.

Hi Mullsey,

We are emigrating to Sunshine Coast in 5 weeks on a Business Owners (provisional 163) Visa, which is a state sponsored visa. Business visa's are a bit of a minefield and depend on lots of different things. From my experience, you sound like you would qualify for this or, i think it is the 160 visa, if you are under 45. You could also look at the Investor Visa.
We used John Mumford at Visa Unit - the emigration experts . Look at their site and it gives a lot of useful information. They did our business plan as well, which we would not have been able to do without them (42 pages long). Agents cost was 6k, but well worth it. And it took about 10/11 months.

Which business skills visa are you considering?

- Business Talent
- Business Owner (Provisional)
- State Sponsored Business Owner (Provisional)
- Investor (Provisional)
- State Sponsored Investor (Provisional)

As a general principle the State Sponsored Investor (Provisional) visa is the least risk strategy, though it does involve locking up some A$750k for 4 years as a means of obtaining permanent residency.

You should also be mindful of the tax advantages attaching to holding a provisional visa as a tax resident of Australia - I have a factsheet on the subject: if you would like a copy please feel able to send me an email or a PM via this forum.

Those who are eligible for a subclass 160 visa are also eligible for a subclass 163. I would generally tend towards the latter, even though it involves the preparation of a business plan and an application for State/Territory Government sponsorship, simply because the threshold requirements for the grant of permanent residency a few years hence are lower if you go for the 163 visa.

Compare the requirements of the subclass 890 visa, which is the usual pathway for a 160 visaholder - as against an 892 visa, being the usual pathway for a 163 visaholder.

This said, and as noted already, the subclass 165 (State/Territory Sponsored Investor visa) involves even less risk insofar as obtaining permanent residency is concerned, as you should not have to meet any other requirements save for (in essence) having maintained a Designated Investment (= State/Territory Government Bond) of A$750k for 4 years, and residing in the sponsoring State or Territory for 2 years as the holder of a 165 visa.

In this regard, see the requirements for the grant of a subclass 893 visa.

Business visas

Hi there,

We have applied to get to oz on a business visa subclass 163 business owner. We sold our business in Jan 07. In our experience it is best to employ a specialist, and they will charge between £4000 - £6000. Our agent is a businessman himself, x accountant and understands and specialises in business visas.

We went initially with a general Visa Agent who really just processed skilled migrant visas and it was a disaster! We had to withdraw the application and start again.

Now we are using John Adams of Immigration2oz.com He is great, very knowledgable and we are very confident we will be over around Christmas time.

The business visa is not straightforward and I dont know your personal situation but you sound like you may qualify but its too big a thing to try to do yourself - in our opinion!

I encourage all considering appointing a migration agent to use a registered migration agent.

By the same token I encourage those who are engaging an advisor for a business skills visa and who want an accountant to provide additional support to use a suitably qualified accountant.

Business owners and investors are likely to have tax compliance and planning issues, that usually necessitate consideration while the visa application is being prepared and processed. The timing of certain transactions can be key - please don't treat the visa application and tax planning processes as unrelated exercises.

If you have a fact sheet on the tax advantages of a business provisional visa holder i would love to see that as we are in the middle of appying for a subclass 163.....garyswift1@yahoo.co.uk

Hi Alan

We have been advised due to our ages etc ( over 45 ) that the only way in is to buy an established business in Australia ( EBA ) after securing a temporary visa through overseas study.
Any advise on this would be apreciated , neither my wife or myself have owned a business before but we have both been self employed and sucessfull in both the UK and Spain ( for 3.5 years on and off )
