I am new to the forum and look forward to getting some advice from you all.
I have been with my OH since Sep 2006, she holds dual UK and Oz Nationality. We want to move to Oz this summer. We have been living together since June 2007, but she didnt officially move in with me till the September 2007 and start paying the mortgage. This was because she had to give 3 months on her previous flat as she shared it with her best friend and wanted to do the right thing by her.
Our issue is that we want to apply in June for our visa, but we dont have "evidence" of co-habiting. We have lots of joint things like joint car insurance, holiday photos, life insurance beneficiaries, weddings attended etc from late 2006 onwards, but not physical evidence of her living with me. (until September)
Therefore, we are concerned that our visa may fail?
Are they strict and should we wait till September to be 100% certain?
I'm applying for the prospective marriage visa which is different as you don't have to be living together. I've done quite a lot of reading on this category of migration to Oz and the Australian Immigration website is really helpful. I think for the De Facto visa they are quite strict about the 12 months.The link is Australian Immigration Fact Sheet 35. One-Year Relationship Requirement so you might be able to find some answers there. If not I have called the Australia High Commisson in UK a couple of times and they were really helpful.

Hi Zoomerang, You could go this way around things as you say you want to be in oz this summer,you partner could come to oz on a 3 month visitor visa and apply for a defacto visa onshore (in oz) but you have to apply before the 3 month visitor visa runs out - so say you both came to oz on august 1st that would give you till begining of november to get the application in. (once the application is in you have to apply to immi to leave oz if you wanted too) that would then give you a year of living together which immi are quite strict on also you may get the option to have an interview with a migration officer(which i did) and speeds things up really quick Have alook at the thread that beckerboodles started its very similar http://www.pomsinoz.com/forum/migrat...umstances.html good luck gizmo

Can anyone tell us if my Aussie boyfriend and I can apply for a partner/ de facto visa when in Oz if I'm on a 3 month tourist visa? Will they allow a bridging visa if it takes more than 3 months to get the visa?
I know it costs $2060 to apply in Oz. Do you still have to do the medical and police checks if you're based in Oz at the time? I get the general impression that it would be much easier to apply in person at an appointment with an immigration official. Where is the best place to do this and any idea how long would this process take - I have to consider that I would be unable to work until I had the partner visa granted.
If not we can apply whilst we're still here in the UK.
