457 to Permanent Residency

Hello,

Well after enduring a extra long winter in Canada, I thought everything was a go. Had a good lead on a job for OH. Well as it turns out, it didn't come through. So I thought, bugger this (I am really impatient) and thought we would try the 175 visa online, as in the begining of Feb we had 120 points. Went through the process last night and damn we now only have 115 points as OH turned 40 in Feb.

Well to say I'm dissapointed is an understatement. Our recruiter in Perth is still sending out resumes, and assures us that she will hear something soon. It will be on a 457 Visa.

My question is do we have to wait two years once we finally get to Oz to apply for our PR visa, or can we apply sooner once we are down there. TRA has been passed and OH's occupation is on the MODL.

Sorry for so many questions, I thought I had it all figured out, and then damn OH had to turn 40. Oh well I guess that's what you get for procastinating.

Any help would be appreciated. I just wanna get out of here as soon as possible and start our new life in Australia.

Thanks

Karen

What is your OH's occupation, Karen?

Have you looked at a State Nomination? Details of occupations that are on WA's Wanted Skills List are here:
http://www.migration.wa.gov.au/Media...EMBER_2007.pdf

Most are on the MODL, which means you should be able to attain the subclass 175 visa points pass mark without a State Nomination, but there are a few occupations that aren't.

Have a look at the wanted occupations in other States too - for example:
Live in Victoria - Eligibility Lists - Skills in Demand
http://www.immigration.sa.gov.au/pdf..._Permanent.pdf

Also, have a look at the occupations that State Governments will sponsor for a subclass 475 visa (note - NOT the 457 visa).

Best regards.

PS. How do you not attain the points pass mark with a MODL occupation?

Occupation - 60
Age - 15
English language (assumed - with IELTS test passed at band scores 7.0) - 25
MODL - 15
Specified work experience - 10

TOTAL - 125 POINTS

This assumes the required closely related work experience for MODL and SWE points.

Hi Alan,

When I filled out the online application I just put that we were proficient in English. How do you go about the IELTS test. We are both english speaking Canadians, although I was born in the UK, so english is our first language. That is where we have lost the points.

If you can give me any advice that would be greatly appreciated. I have found this site very useful, as we are in Canada and there aren't too many sites that are specific to Canadians.

My OH's occupation is Sheet Metal Worker 1st class. The Tra passed under that occupation.

Thanks again for your help.

Karen

Karen,

It looks like you have 2 options at least:

- seek a State Nomination from the WA Government (assuming you want to move to that State) and then apply for a subclass 176 visa: the points pass mark for the 176 visa is 100

- your OH does an IELTS test and (all being well) secures the necessary band scores to obtain 25 points for English language competency:
Skilled – Independent (Migrant) visa (subclass 175)

If you would like to discuss further feel able to telephone us - it may be best to call us in Melbourne on +61 3 9935 2929: ask for my colleague Stephen Dickson or me.

Best regards.
