me and my husband would like to move to Australia because or three daughters are all making the move and we wqnt to be with them.
The problemis we are both 45 my husband is a selfemployed plumber and Im a admin assistant for the NHS. as anyone this age already made the move? if so how do we do it?

Hi Lynn,

Not sure if it will help but we are going over on a business visa 163. My husband is 46 and I am 42. If your husband ran his own business here with accounts etc would this be an option??

The down side is that we have to run a business over in Oz before we can apply for permanent residency.

If you do think this is a viable option contact me and I will give you more details.

Hi Deb

Thanks for that information, is this the only option or is it the best and the quickest it all seems so hard i dont know how people manage to get there!

It would be great if you could send me more info on the business visa 163.

My husband would like to continue to work for himself in oz but it is a bit scarey when you dont know anything about the area ect.

how far into the process are you? where in oz are you hopeing to go?

hi again Lynn,

We have actually got our visa and hope to be in Brisbane late April early May (feel as if I'm changing that date constantly!) It wasn't hard work for us because our agent did everything but we did pay for the priviledge (or rather our company did!) I think our hard work will really start when we land?

I shouldn't think it is your only way in but I am a complete novice regarding all other visa routes.

I have read some really good things on this forum about Alan Collett/ Go Matilda (apologies if I have got the name wrong!). I am sure that others will post with other options available.

I will send you a private message regarding the 163 visa.

Hi again Debs

We have got a agent, we are useing emigrating expert. they have sent us a letter and some info that does say we need a state/territory sponsored business owner (provisional ) subclass 163 visa. The info they have given us as still left us in the dark.

I hope you get there soon, we hope to be in the Brisbane area never no i might see you there!

Welcome to Poms in Oz.

You may have several visa options, daunting though it might all seem just at the moment.

Like Debs (bunnyboo) my own first thought when I read your post is whether or not you could take the subclass 163 route and whether that is something you would want to consider?

Another option would be to consider an employer-sponsored visa for Hubby. Pease see here:

The 3 visas involved would be the temporary 457 visa to start with (maybe) followed by either an ENS visa or an RSMS visa. With all 3, there is an age-exemption. Please see here:

If Hubby also satisfies the MODL & ASCO definitions of a Plumber and can obtain the necessary skills assessment, then a visa is virtually assured provided that an employer/sponsor can also be found. Please see here:

The trouble with either of the above options is that you would not necessarily be able to find State or Employer sponsorship in the areas where you might want to live and which one or more of your daughters might be planning to move to.

However, how many children (including children of previous relationships) do you and Hubby have between you, because Parent migration might well be a viable (and possibly even better) alternative for you. Please see here:

Please read Booklet 3 carefully.

I think you should speak with a Registered Migration Agent and specifically I think you should speak with Alan Collett, the Boss of a firm called Go Matilda.

The reason why I would suggest Alan above all the others in this situation is because he is a Chartered Accountant in both jurisdictions as well as being a Registered Migration Agent.

I think this is significant because:

1. He could quickly assess Hubby's current business to see whether a subclass 163 visa would be a goer.

2. If it would be, then Alan knows exactly what DIAC want out of the Business Development Monitoring exercise that they do, without which this route to PR is not guaranteed.

3. If you were offered a subclass 457 (temporary) visa to start with instead then there are some tax-perks with it potentially but they may not be likely to work in your favour. There is also tax down-side for sure, particularly if you want to buy a house out in Oz.

4. If an employer tried to offer you a 457 visa to start with, Alan would be in a better position than you to convince the prospective employer that he would prefer to sponsor you for an immediately-permanent ENS visa instead, which contains less restrictions on the employer than a 457 visa.

5. If you were able to apply for a Contributory Parent Visa today, you would be looking at a total cost of around £42,000, I'd say, including Agents fees, sundries (eg Meds) and the none-too-good exchange rate at present. You would get abut £5,000 of that back after 10 years, but none of the rest.

However, when you tot up the costs of the possible alternatives, this would not necessarily be a bad deal for you, I suspect, plus you could live where you like and do whatever yu want to do employment wise subject only to Hubby getting local plumbing licences if needed. You would not need to bother with a skills-assessment etc.

6. My final reason for suggesting Alan is because he also knows about the international tax aspects of the three possible options and what they would entail for you.

Hi, i believe you can also go for the company sponsor visa which is subclass 457 and from what i believe there is no age restrictions on that. We are not 45 or over but we are in Sydney on the 457 visa now. Gill may be able to give you more info as she is good with this thing

Your reply to Debs crossed with my reply to you.

With all due respect to Emigrating Expert, in your shoes I would use Alan Collett instead because all the information you might need about all the various aspects of this would come out of the same head if you use Alan, so you would not end up with something so bitty that it would potentially be hopelessly garbled and potentially also inaccurate.

Alan carries the full range of "tools" needed for you in the one body and he only has one mouth with which to advise you, if you see what I mean!

Hi Lyn,

Following on from Gill's advice, which is really great, my main concern for the subclass 163 visa for yourselves is, would you meet all the requirements? Obviously your agent thinks so. I don't how your hubby operates but we applied as a limited company, with 5 years trading, turnover in excess of £335k and staff levels of between 5 and 11 dependent on which trading records you where looking at.

This is a long winded route and it was pretty expensive for us. But our path went along these lines;

Form 956 - Appointment of a migration agent (so they can deal with all the paperwork)
Form 949 - Request for sponsorship - filed with all forms to Queensland
Form 1136 - Business career evidence.

Form 163 - Business Migration proposal - goes over to Queensland and details background, business proposal, assets, bankruptcy details.
Business plan - based on info provided by us but written by agents.

Form 47BT - completed by myself as main applicant (covers dependents, family background, qualifications, experience, health and character)
Form 80 - both hubby and I did this one, general info including family, addresses, education, occupation, employment, visits to Oz).

Early on we received a letter from Queensland stating that they would sponsor us and after sending off the relevant paperwork to the immigration service this was followed on by a grant letter stating that we had been given a 4 year business visa.
It also details your obligations under this visa including projected turnover, employing staff, monies invested in company.

I don't know how this compares with other visa applications or how it compares with yours and your husbands business experience? Neither do I know the basic requirements for using this visa route.
