Mental health act.

Hi all again.

Ok here goes. 12 years ago at a bad time in my life i tried ending it all and to cut a long story short got sectioned under the mental health act. After 14 days the docs relised i wasnt mad but depressed and was released.

Will this show up on a criminal record check and if it did would this stop me getting a visa. I know its not a criminal offence to get sectioned but have heard that it is kept on your record anyway. Any info would be great as this is all thats stopping me from starting the prosess and would also stop me from worrying.

Hi there,

I'm not sure about what, if anything, goes on your record but I'll ask a friend at work tomorrow who is a mental health trained social worker, she might know. As for it affecting your chances when applying I would contact an agent and get some advice. One of the bigger migration companies may have had other clients in the same boat. If it was 12 years ago, thats a long time really, I would hope your chances wouldn't be affected, I'm sure there's people on here that could offer some more advice,

It is not a criminal of character matter, just a straight forward health matter. Will require psychiatric reports/assessment but as long as the reports evidence that youare no mader than the rest of us, then you will pass.

I dont know the answer to your question but I do remember the one and only question asked directly to me when applying (I had an Aussie husband who had to field most of the questions) and that was "have you ever been in an institution for the criminally insane?" I doubt that they meant a "psychiatric ward" but you should get advice from your agent about what you need to disclose or whether it will appear in any sort of report.

Thanks for the posts. Anyone ever emigrated dispite this or any police officers on here that could give a deff answer about the checks. Thanks.

Hi, know what u mean, we want to go but oldest son has history!!!!!
Decided to try cannabis (obviously unknown to me) which ended up in him having mental health issues, he is fine now BUT will this affect us going? Obviously wouldnt leave him behind!

THE PROBLEM THERE MIGHT BE IF HE GOT INTO TROUBLE WITH POLICE FOR USING CANNABIS ..... FROM WHAT I HAVE GATHERED FROM OTHER POSTS THEY DONT TAKE TOO KINDLY TO DRUG OFFENCES .... IT WOULD DEPEND ON THE CIRCUMSTANCES .... ARE YOU USING AN AGENT ?

no problems with police at all...it just made him go really depressed etc. no other problems with him, but obviously in his medical records! Been fine now for about eighteen month, hurray!!!!!

I'd be inclined to agree with Mrs Keily, an agent is probably the best person to advise you. My friend at work says as far as she knows, if you were under a section 2 then she's pretty sure nothing goes on your police record.
