Question Eligibility of sponsor for spouse visa - Help!

Hello,

My partner and i are in the process of applying for a de-facto spouse visa. My partner is an Australian citizen by descent and so has a citizenship certificate as well as an Australian passport.
Question 25 (40SP) asks 'What is your citizenship status in Australia?'. The tick box options are...
  • oz citizen by birth
  • oz citizen by grant
  • permanent resident of oz
  • eligible NZ citizen.
The obvious answer would be 'Oz citizen by grant', however, next to this box asks for 'date of arrival in Oz'. My partner cannot answer this as he has never been to Oz, never mind lived there.
I'm now having a panic about his eligibility to sponsor me. I can't find anything in the small print but, knowing my luck, it'll be in there somewhere!

Does anyone know whether he can still sponsor me even though he has never lived in Oz. Has anyone else come across this?

Hi Lucia,

My Husband is sponsoring me and he has not lived in Oz since he was three years old. I can't see it being a problem for you if he has an Australian passport.

Have you sent off your applications yet? We're still waiting for stat decs from friends - a little unreliable i'm afraid!

Have you any idea how long it takes for a spouse visa by the way?

Hi Lucia,

Sorry for the delay in my reply,I have just been to the Cinema with my son!

We sent our applcation in on 21st November 2007 and was told we would have a 4 week wait! 4 weeks to the day we had a request from our case officer for some more documents. Of course this was a few days before Christmas! I submitted everything three weeks ago, our agent spoke to our Case Officer last Wed and she was told we would hear before Friday BUT nothing..........

Spouse Visa's are supposed to take between 4-6 weeks.

Hi

Dont get disheartened ours (my hubbys spouse visa) only took a matter of weeks to get we submitted the application with police checks and everything except for medicals on the 1st December , (that was a friday ) and by the tuesday we had a case officer and he requested the meds which where booked for the friday, they were sent of and we got the visa on 18th December 08 and thats with us waiting for my family in Oz to send a sat dec back!!!!!! But i have to say that we did use a Agent who was brilliant! I couldnt be dealing with all the paperwork !! It might of helped , that we have been together for 18yrs!! . anyway good luck to the both of u!!!
