how can i get to oz now?

hi all,

i think my agent really let me done, he did not even appeal on my behalf when my tra was declined...................i've already paid him £800 and im not happy, i know he couldn't fore see the changes but still you could have backed me up and appeal for me, i really still don't understand it and still have no answers..............my tra was in in time if you don't know yet i still failed and was assesed under different pathway, why?, i still don't know and tra still have not answered any of my emails. Trust me this tra application would have passed under pathway d and was not given the chance even though it was in on time and even before others who passed.
Anyway is it worth holding on for the changes to come back or is this wish full thinking?
What are my options now apart from recruitment sponsorship?
Is there any possible viable way for me to get to oz right now?
Is it worth taking action against tra or is this just a waste of time or simply too late?

please any help would be grateful, as i so badly want my son to start school there next jan

Hi Jason, im really sorry to hear your bad news. I dont have much advice, we were rejected as well as we got it in on the dealine for plumbers to be assessed at TRA but they sent it back saying pathway d was closed......unsure why that effected us as OH has City and Guilds. But, we decided to go thru vetassess later this year and avoid all the agro (they returned our money as well)

What do you do? and did TRA tell you why they failed you? was it just a lack of info? i know question 8 can be an epic writting session....
And have you made a complaint againts your agent?? this is what you are paying them for, they should be helping you. some of them seem to want the money for very little work and some will pull all the stops to help.

I hope that someone will be able to offer you advice that will really help, unlike mine! but i wanted to let you know you weren't alone. I'll keep everything crossed you can get there for next january

First things first, my friend.

Ditch your current Agent without further ado. OK - you have wasted £800 onthis guy and he couldn't even be bothered to lodge a formal Appeal for you, it seems. However, this same guy recently triedto "advise" you to hand over £3,700 to some other crony of his, it would seem, on the strength of nothing but a theory that has yet to be proven to work convincingly.

So whatever you do, have nothing further to do with your present Agent, I strongly suggest. Whetheror not it is worth a complaint to the MARA depends on a number of factors.

Firstly, is the Agent MARA-registered? You can check by searching here:

Migration Agents Registration Authority

If he is not MARA-registered (and does not fwork for a firm whose Princioal is MARA-registered) then the MARA can do nothing to help if the Agent is outside Australia.

Can you prove that you issued formal Instructions to appeal and that he ignored your instructions? Without that, you probably wouldn't get far with the MARA or with the Court.

Also, crying over spilt milk only makes it salty for the cat, honey. It would do othing towards improving the quality of your family's life.

For what it is worth, I think they will have to do somethign about re-opening the gates for people in your position because without you, the Australian work-force will simply end up in evn greater needthan it is in now, which would certainly dampen the economy, to say the very least.

The question is how and when they would re-open the door. The TRA have told everyone to expect further news "early in the New Year." When a bureaucrat says that, he means "Hopefully before Easter but failing that, hopefully by 30 June."

Jason, they knew they wre going to close Pathway D quite a while before they did so. There is no way it was a "spur of the moment" decision, even though I'm surprised nobody in the TRA leaked the inside track information to the media in advance.

So they must have some ideas about what they can now do to come up with a new, improved replacement for Pathway D.

For the minute, I'd suggest a PM to Janette (who posts as Mrs Braveheart.) The Agents who got them their job and visa may be able to help you as well (I don't know who the agents are.)

Thinking Australia might be some help as well. It is run by a guy called Darrell Todd. He is not a registered Migration Agent but my impression is that TA do more than simply organise visas. I think they have links with recruitment specialists as well.

Billy & Janette (the bravehearts) tell me their agent was superb. Billy had been let down by one agency quite badly and as a result was at the age deadline for the visa, he changed agents and they're here in WA enjoying the sunshine. Send either a pm and they'll get back to you

thanks for all your help.................it's funny, i seem to get more help and advise from you people than i do from my agent.....................looks like im gonna have to swallow the fact his took my hard earned cash and then find someone else, but even doing this is no guarantee at the moment as there really is not any viable pathway open to me right now...................i could get a qualification in floor laying, but it would feel a bit strange as i've been doing it since i was 14 and know the game inside out, so to go back to school so to speak would just not feel right, if i ever went back to school i would like to learn new skills, not skills i already have.
