Help and Advice needed Please

Hi I am hoping someone may have been in the same situation as us and can advise.

My partner is in the final stages of interviewing for a job in Oz the deal would be an EX Pat deal and would be for around 1-3 years.

We are not married and I have a son from my marriage I am now divorced but we have joint custody. What agreement do I need or legal paperwork to bring my son to Oz for the duration of my partners work.

Hi Lisa and welcome to PIO.

The situation was slightly different with me and my ex as I have sole custody of the children altho' we share parental responsibility. The minimum requirement for the visa is a signed consent form from your son's father (which has to be witnessed by a solicitor). Otherwise you can obtain a order from the courts. If you do end up going thro' the court process I would advise agreeing arrangements with your ex before hand otherwise it can get messy.

Hi Lisa,

Welcome to POMS. My situation is slightly different than yours, i have sole custody of my 2 children but they go to their dads every weekend. I contacted my lawyer for advice when my new partner and i decided to move to Oz and she said that i needed him to agree and to make it legal. I spoke to my ex husband and he finally agreed to let them go. My lawyer made up an agreement which we both had to sign and there shouldn't be any problem now (apart from the fact that my ex has now announced he is planning to follow us out there once we are settled)

Not sure how it will work for you because you both have joint custody, have you told your ex yet that you are going?
