What If...

Here's something I'm hoping someone can help me with.

We are moving to Adelaide on a 175 visa. Thats myself, Tracey and our 4 children. My 16 year old daughter from a previous relationship is coming out with us when we fly out for a few months. What happens if she decides she wants to move out with us permanently? She hasn't said as much but I want to know where the land lies should she want to. I'm assuming she can't just be added to our visa. She has just had to have her medical done for our visa. Would she have to wait until we have been out there for some time to be sponsored? Or is there another way?
If she had mentioned coming out with us earlier we could have added her to the application before we lodged it. Then she could decide whether to come out full time or not and there would be no problem.

Hi Pete
I can't really help that much but...............

If your daughter is living with your ex partner / wife you may need to find out if you will have to go through court to gain sole responsibility for for her.

I'd definitely check in case it holds your process up.

If you can have sole custody I don't see there being a prob!

It won't hold up our process coz she isn't on the visa at the mo. My fear, if fear is the right word, is that once there she may want to stay. How would we go about it? Her mother says she wouldn't have a problem with it. Just wondered if it was easy or a long drawn out process. Or indeed possible.

Hi Pete

If your 16 year old daughter is financially dependent on you, then I believe you would be able to add her to yur existing application. One can certainly add or remove Contributory Parent applicants right up until the moment the visa is granted, apparently (and astonishingly) so I'd be surprised if it is different with any other visa because they all use the same general boilerplate.

As to the procedure for doing this, I'm sorry but I have no idea. In your shoes, I think I would ring the ASPC to enquire if you are not using an Agent. Ask for the Manager, I would suggest.

Alternatively, you could wait till your daughter gets to Oz and see how she feels once she is there. If she wants to stay on, an onshore Child Visa may be possible.

If this were me, I'd be inclined to lob George Lombard a few quid to help with this query because he is in Oz. You can contact him easily via British Expats. Because George is in Oz, he tends to know about onshore applications.
