Thanks for that - I will look at this way I think. Only problem being is my sister is also over here and I think she will be going for the last sibling?!
In a strange situation I know! Lol. I think ill read through the immigration website.
OH in army, his time with the uk army runs out next june, didnt really want my kids in uk...but just after reading on here today..might sound like we are jumping out of the frying pan and into the fire..hope people will mail me diffo!!??plz? anyway hes transfering over to oz army..nothing to lose, may sound dumb but we have never even had a holiday in oz, so havent really a clue, but then have nowhere else to go either..beggers cant b choosers and all that!, been looking at the visa sites as daughter will b 18 and left school and might have to get diffo visa..just to make things complicated!!, now might not b as bad though as will apply for it wen she is 17 and at school like now!...bummer yr sis is younger!!lol..loads of people on here should be able to help you, seem to b friendly bunch. how come you didnt move out with yr family anyway? i have been to basingstoke goood shopping, used to live salsbury area, didnt like it, but then my family live in kent..would never go back!! did settle in devon for a few years, we all loved it, just know work, and kids would never be able to afford a house there, so as the option for oz came up we thought why not...cant bloody wait. we going to holsworthy, near liverpool....do you know it? where do you family live, do they like it,?
im going for the last sibling! if your sis is still in the UK then i doubt you will get on that not sure of majority of family, from what i know (which aint very much) last sibling is if you have no parents siblings or dependents over the age of 18, so if you have a 5 year old kid who lives with you or depends on your income then she is regrded as a dependant and gets harder to get the visa! only if thats the case , im looking into it a lot at the moment so if i get any info that may help you ill let you know.
regards
todd

Hi Todd,
There could be two things that you may be thinking of, some of which have been touched on by other posts.
If all of your birth family (parents, brothers and sisters) live permanently in Australia, you may be eligible to apply for the Remaining Relative Visa. However, if you are currently married (including separated) then the brothers/sisters/parents of your partner are also counted - for the purposes of migration - as your own.
So, if you are married to a lady with three brothers living outside Australia, you would not be granted a Remaining Relative Visa even if your own family were all living permanently in Australia. You are right about dependency; adult children may be counted if they are independent of you. Be aware of any partner independent children as well!
Secondly, you may be thinking, as Mark and Connie mentioned, of the 'balance of family' test which applies to all parent visas. The test says that the applicant must have the majority of their children living in Australia, or more children in Australia than in any other single country. So, a person might have two daughters in Australia, one son in the UK, one son in Canada and one daughter in South Africa, and still pass the balance of family because the greatest number of children are in Australia.
I know you want to come to Australia (and why wouldn't you, ha ha ha!) but can I just say that I loved St Andrews, what a gorgeous town. My Mum is Scottish (Edinburgh and forbears from the Islands) and so I spent five weeks there, oh, years ago. I just loved St Andrews!
hi vicki
thanks for the info.
im not sure which visa i will get at one point i thought it would be straight forward but the more i look into it the more i question if it will be or not, i have no sisters in the UK as they both live in OZ with my parents as does my brother in law and nicec and i have no dependant children, wife or ex in the UK. my sister is going to phone the govermeant at some point today in Perth and when i get told 100% yes and i have it in writing then i will start the process!
i have way to much to loose to try and get a visa on a "maybe" with regards to my job here in the UK.
thanks again for your help.
regards.
P.S your right about ST Andrews its a very nice place always good for a weekend away as im from close to there myself.
Yes Basingstoke is good for shopping! I dont know the palce your moving too - My parents live in Hocking, perth.
To be honest my parents hadnt had a holiday to Oz either - first time they went was house hunting! They absolutly love it! I didnt move becuase I was no longer dependent when they were accepted. I think I might look into the last sibling thing tho!?
