medical's for childre staying in the UK??

Hi

With regard to this topic, has anybody been through this process…

i know DIMIA regulations state that all children require medicals

I have a 7-year old little boy David whom lives with my ex partner, I informed her what I was doing and told her that David would need to take a medical. (All is well so far, even arranged for him to come over in the Hols)

I now need to get my immigration meds done and surprise surprise she has changed her mind (seems she did not like the fact that I would be marring my present partner) no medical for David.

I do not have parental responsibility for David, however my name is on the birth certificate, I do have regular contact, and I do pay voluntary maintenance

Do I need to start grovelling?

Hi mark,

If you can't get it done, there are some previous threads from people who have taken solicitors advice etc., hopefully, it may not get that far (fingers crossed), but if she still refuses, there are avenues to go down and you could still get your visa even if she refuses.

The Department of Immigration recognises that there are situations where children from a former relationship cannot be compelled to attend a medical examination.

However, the Department will expect to see evidence of efforts made to secure attendance at a medical examination.

My view is that it is generally best to have a migration agent on board to guide visa applicants where circumstances such as those described by the OP exist, not least because it can be stressful, and experienced migration agents ought to be able to explain what is needed to satisfy Department case officers.

This isn't usually an insurmountable issue, but it needs to be managed properly and appropriate documentation obtained so the health requirements can be satisfied.

Thanks for your help and input - it's been some time but I now have a Visa under my belt....

the Ex never agreed to a medical for my son or even acknowledge that I had asked for one - I supplied evidence that I had made attempts to get a medical
  • solicitor's letters confirming my legal rights over my son / or none rights
  • solicitor's letter stating that I would not win if I went to a court of law (to get a medical)
  • that if anything would to happen to my Son's mother I would apply for him to join me on a separate family Visa.
  • letter to my Ex asking for medical etc from my solicitor (and her none reply)
I tied all this up with a statutory declaration (uk version) with my previous attempts to get a medical

a long wait + 2 months on my Visa application, and today APPLICATION APPROVED

congrats on your visa .we are in a simlar situatation so really pleased there is ways round this
