Hi just wondered if any one has xperience of getting a child of a previous marriage out of the country?? My ex who hasn,t seen mu daughter since she was 2 & she's now 13 seems to gonna be awkward about signing a stat dec letter for her to leave. What happens if I go thro' the court? How long does that procedure take & do you know if its costly?? Thanks for any info but i'm worried that we may get so far down the line an hit a brick wall!!

My ex has never even met my son, he is 15 now and has only ever know Paul as his dad...
We asked my ex to sign a stat dec and he said he wouldnt, and then said he was just being awkward....We telephoned the local court and told them our dilemma, They sent us out some forms to fill in, and had to pay 170 quid for a hearing..We are not using a solicitor..Our first court hearing was 26th Feb, and was adjourned because again my ex was being awkward and told the court he never received the court papers until the last minute so had no time to prepare..The judge has relisted the hearing and asked us to get as much information as we could so he could see that our son would have a better quality of life in Australia.. IE: School acceptance letters, schools in general in the area we will be moving too, A copy of Pauls job offer and the situation on our housing once there.
We have already been in touch with a school for our son, who have said they will accept him once in Australia, so that was pretty easy...We have a case Officer and he is now just waiting on the outcome of the hearing to finalise our visa..
WE GO BACK TO COURT TOMORROW !!!!! It has been one of the longest months of our life but fingers crossed it will all go well....I would say dont leave it till the last minute as it could take a couple of months to sort it..But all said and done 170quid aint bad

BL8888 HE**!! We haven't even got jobs or a home or anything. I have a letter from the x to say he wouldn't stop us & knows it's for the best(its signed, dated,& has his name an address on) but it's not verified by a solicitor ! He onlt sent the letter cos he was havin' another kid & didn' wanna' pay anymore CSA!! Typical self self!!

Good luck for tomorrow, but it amazes me that it has to go to court because your son has never even met your ex, another shining example of our law system in this country!!!
That is so crazy that you have to go through that in those circumstances - where the hell is the common sense in the world!! Certainly not with the people who make the rules!
Your ex will have to also give you a copy of his bio data page,certified by a solicitor..the letter wont stand on its own...Pauls mum, partner and his brother and sister in law live in QLD. so it has been a little easier for us, although we really have done most of it own our own, it was just a case of trawling thru the net looking at schools and then corresponding by email, also looking up building companies in and around the area we are going to live..After speaking on the phone and lots of emails, they have all asked Paul to come and see them on our arrival into Australia..However Paul has secured a job with a friend of his brother, he owns a building firm and so was kinda lucky there..
it has been 2 years of hard work and at times we have almost given up but we want this too much to let anything get to us....

Hi JO what's your son think of you moving to Oz ? Any probs there?? My daughter who's 13 was a bit resistent at first, y,know all thats important are her pals!! I told her she could get a boyfriend named Chad & hit the surf... It seemed to work! She's prepared to keep an open mind cos if the TRA gets accepted were off for a months holly at Xmas so's I'm also tryin' to look upo holly accom too!!
