returning to Aus with a family

Hi People I am new on here have been reading for awhile now. My Question is much different to alot of you's I am an Australian Resitant I have been living over here for 3 yrs I have 2 older sons 19yrs and 20yrs the oldiest is in Australia with his father the younger one is here with me. My son who is here has just started a new Job with (Gary Rhodes) he is a chef. I am having to return to Australia this year before my visa runs out. I have a new husband and a baby who will be 2yrs in April. My problem is do I apply here for them to come to Australia or when I return. Could some please give me some Advice.

Hi Paula,
Welcome, there will always be plenty of peeps to help you out and advise the best way to go,

You say you are a resident, well my hubby is a citizen and he left oz in 2002 and lived in the uk untill 2006 when he brought me and my youngest daughter to oz with him, I applied for my spouse visa whilst onshore (in oz) and only took a very short time to come through. It is all very easy to do spouse visa that is and can´t see any real problems ahead for you, have alook at www.immi.gov .au and the link http://www.immi.gov.au/migrants/family/index.htm - you are able to sponsor peeps when you are a pernament resident, im sure you will have no worries,
perhaps also look for a free online assesment test too.

If you lodge a spouse visa, you can include your baby in it - one application, one fee (although it'll be two medical checks).

I'm a little confused as you say you're an Australian resident but you need to return to Australia before your visa runs out.

Do you mean you're an Australian visa holder (permanent visa I presume) and you're now in the UK and are looking to head back to Australia soon.

What visa subclass do you hold? If you hold a skilled visa, you should be okay to sponsor your husband. If you hold a spouse visa, there are restrictions on your ability to sponsor your husband.

I suggest you speak to a registered agent to talk through your options, even if you plan to do your visa application on your own.

Hi Peter,

I emigrated with my Parents when I was 14yrs old I have Just had a look in my Passport and it says a sub class 155 If that means anything to you.

Hi Paula

Subclass 155 means you hold a Resident Return Visa.

You should be able to sponsor your husband and son for a permanent spouse visa (based on the information you've given here and the assumption that you haven't sponsored another partner in the last 5 years).

Like yourself, I left Australia on a Resident Return Visa which gives you five years before you must return to Australia. I sort of assumed that near the end of the five years, I would just get another RRV for another 5 years so I could continue living in England with the woman I met over there and married. However the RRV is not extendible, sure you could apply another one but the trequirements were to have lived in Aust for two of the previous 5 years which of course I hadn't, I'd been in the UK and Europe.

So we just packed up, hopped on a plane and came over. Gillian then applied here for a spouse visa. An interim visa was issued on the spot, then we just had to show that it was a "real" marriage by producing joint bills (the true sign of marriage ?!) and various other bits of documentation including photo's, proof of shared holidays etc. The process was quick, straightforward and painless.

Hi Bullcreekbob,
Thanks for the info it sounds pretty straight forward, I will have to get my husband & baby a return tickets ? what happens when we go through customs will they ask question about our return, I am on a oneway and they are on a returns. I must bring all the documents in our cases also. Would there be a problem if I said they were coming back for good. Also I will have to get hubby a Police check before we leave. One more question do we apply for a spouse visa and have the baby added to that ?

Hi Paula,

The best thing to do is what i did (i assume you are gonna apply onshore in oz for the spouse visa) is get your hubby & babe return tickets and yours a one way (like my hubby did as he citizen in oz) then there can be no questions asked. I know it seems extra money but if you check with who you buy your ticket with you could always sell them on, i coudnt as used the flight centre and had a over night stay at hotel in Shanghi which all got wasted.
