Advice for a confused person!

I am 18 and currently living in france with my family. My family are moving to australia in the next 2 years I think and i would go with them on their visa, but I have a french boyfriend who is 19 who i would want to come with me...can anybody give me any information onto what visa he should take and if it is difficult etc etc! and if he went over on a works visa for a year could he enroll in college or must he get another type of visa anything related to these questions would help me..

Hi Becci

I treid to copy your thread into the Migration Issues section of the forum, becuse we have a couple of Migration Agents who help with the site and I wanted to ensure that one of them would see it. However, I made a hash of trying to copy the thread, so I've PM'd the agents instead with a link to this thread where it is!

Can you tell me a little more, please?

Have your parents already got visas for Oz and have they been validated?

What are you doing, currently? Are you still at school/college/uni? It is just that since you are already 18, I am wondering whether your parents might have a problem with saying that you are dependent on them, still, the more so two years from now?

I think your own situation could be tricky, so I want to ensure that the Agents have more information about you, in order to help them to help you.

ok...No we have not applied for them yet but i think we will be in the process of doing so in the next month, my step dad might also be able to have work where he would be based in australia if that changes anything.
I have lived in france for a year and a half now and took a gap yeat after my GCSE's to move to france and become accustomed to the language and lifestyle. at the moment i am just trying to look for a job..
my boyfriend is not entirely fluent in english but very very near and in half a year he would be totally fluent no problem.....he also is in college doing a "bac" its the french equivelent of a degree in printing and on the list of "needed workers" printers are on them.....if you need any more information then just contact me

Although your boyfriends occupation in on the MODL he would still need to have experience working in this field before applying for the TRA. He may also have to do an English Test.

I agree with Gill in that you may not be classed as a dependant child and speaking to an agent will help clarify this for you and help you to identify your best visa options

Thanks....well my boyfriend is on an apprentiship for that and works in a printing place aswell as gonig to school! Apparently according to my mother we are taking a skilled workers visa as my step dad works on the oil rigs and could be based in Australia. This is all very confusing!

Hi Becci

I can see that this is difficult for you when you are not in charge of your parents' application and your parents probably aren't that concerned about whether or not your boyfriend can go with you. (Plus his own parents might well hope that he can't!)

I reall think that your parents need to speak with a Registered Migration Agent because although it may be very straightfoward for your parents, and for any children younger than you, I think there could well be quibbles about whether or not you can be included in the family's visa-application as a dependent child still.

If you cannot be, then I suspect it is going to alter the whole picture and it might be that your step-father would not take the job. So I think you really need to find out more about your own status before we start trying to work out a route for your boyfriend as well.

There are about a dozen different skilled visas, some of them temporary, others immediately-permanent. Try to find out whether your mother can tell you which subclass of visa is being discussed. (How old is your stepfather, by the way, because that might narrow it down?)

Look where it says applications and forms. There are application forms, information forms about every visa, and information Booklets about the different main visas. Th information forms and Booklets are particularly useful.

There appear to be none in France. No worries. There are several in the UK and in Australia. If you go to the Register of Agents, where it says "Find an agent near you," use the Down arrow to select Country and then type in the country name.

If you do a search on here headed "migration agents", you will get loads of names.

Shout if you want more help at this stage, but I would say let us focus on you first. Once we know whether or not you would be able to move to Oz on your parents' visa, then we can start thinking about how to get your boyfriend there too.

Hi Becci

When you turn 18, to be included in your parents' visa application you must be considered "Dependent". this means financially dependent for basic needs being food clothes and shelter. So when you get a job, you will not be dependent - so Dependency on your parents will mean you should have little or no income at the time of the visa applicatio nand at the time the visa is decided.

Assuming you are accepted as dependent and get your permanent visa, you and your family will have to make an initia lentry within about 9 months of getting the visa and you will have permission to re-enter Australia as a permanent resident for 5 years from when the visa is granted. When you have validated your visa, yo uare free to return immediately to France without your parents and join the many time during the 5 year validity of your visa. Your boyfriend's situation is independent of your situation and he must qualify for any visain his own right. He could apply for a working holiday visa which allows work of up to 6 montsh with any one employer and study/training for up to 4 months. He could apply for various student visas. Assuming you would be a permanent resident while he is in Australia, you could sponsor him for visas if you were married or in de-facto spouse relationship for 12 months or more. Or he could eventually qualify for his own permanent visa via studyiong in Australia or gaining skills and experience outside of Australia.
