Born in Oz which means I can get oz passport - What about OH

I was born in Oz to british parents but have lived in england since I was 2. Have just found out that I have dual citizenship and am applying for an australian passport for me and my 2 children.
What do we do about my husband?? (much as would love to leave him sometimes I suppose we should take him with us! )
We are looking to migrate to the Brisbane area in 2 years? What sort of visa does he need? Can I sponsor him? Most grateful for any advice.

Hi Lolly

I believe you should be able to get a spouse visa for Hubby. It is a very fast-track visa. I think you get them within a couple of months, from what I've read. I think the idea is that you get Hubby his visa before you leave the UK an as far as I know, you do that through the AHC in London.

Please see the three links below:

Look through old threads on here (or do a search) for threads and posts by Dunteaching. She is also an Australian citizen, has been in the UK for several years, is married to a Brit and is in th process of getting a spouse visa for him at the moment. She submitted the application a couple of weeks ago and could give you LOADS of assistance, I would imagine.

Good luck with your plans

Gill

Hi,

Gill is right, I am an Aussie citizen and we did put in a visa application for my husband two and a half weeks ago. It arrived on Friday 19th and on the Saturday our credit card was debited. 10 days later my husband had an e-mail of acknowledgement from a case office. She had been on holiday since before Christmas (we are all in the wrong jobs) and asked for an original of my husband's police clearance from his time in Saudi Arabia when he worked for British Aerospace. However, Saudi refuses to supply that sort of information so we had included a letter from British Aerospace stating that he had no convictions. My husband e-mailed the case officer back with this information and we are now waiting for the visa to be approved.

We have been together for 6 years and married for nearly 4 so our application is pretty straightforward. However, it still took quite some time and money to get all the paperwork together. We put in all required certificates (marriage, birth) together with stat decs from as many friends and family as possible and work colleagues etc. We are hoping that my husband will get immediate PR but maybe that is wishful thinking. Apparently the visas take between 3 and 11 weeks. I have read elsewhere of people getting immediate approval, but I think that is unusual. Our three weeks is up on Friday of this week so that's when we'll start checking e-mails at silly times! Hope this helps.

Hi Dunteaching

Thanks for the reply....I have a few q's if thats ok?

I have just read through the forms that Gill recommended and it seems quite straightfoward....did you use an agent?
I dont know any other aussie passport holders or citizens to do all of the proof of relationship stuff. Did you or did you use friends/collegues etc from the uk?
We have been together for 14 years and married for 10 with 2 kids so hoepfully our application will be pretty straightfoward too.
Let me know how you go
Thanks again

Hi,

We were going to use an agent but the advice on here was so good that we decided against it. I think if it had been a more complicated application (step children, skills visa etc) we would have used an agent.

All of our statutory declarations were from the UK which doesn't seem to be a problem. Family and friends were not enough apparently so we also asked work colleagues and as I work in a boarding school I was able to ask the parents of some of my girls.

Also produced a letter from my employers stating salary and length of service, joint bank statements and copies of family holiday details for the last 5 years. I think two children from a 14 year relationship is pretty conclusive proof!

We meet the requirements of a Partner Visa but still feel as if they made us jump through hoops during the application process. 200 years ago all you had to do was nick a sheep and you'd be over there like a shot!

Good luck,
Louise
