ex partner problem

hi new to this site but looks really helpful and quite funny!! well we have been accepted on tra hubby a builder me a lazy mum of three. eldest is 13 and i was married before other two kids are twins aaahhhh age 6 big problem though cant get to excited about tra news cos have to go to court to get eldest sons ok to emigrate as his useless waste of space dad wont sign the ok any one else had this prob please thanks . :roll: [/u]

Hi Jacky and welcome

LOADS of people have been in the same situation as you. Loads. DIMA will accept an Order from the Court in the UK without a murmur.

It makes the whole thing beastly stressful for you when the visa-process itself is quite stressful enough without this hassle on top, I know. But you hang in there, honey. Whan is the Hearing? Please let us know the outcome, won't you? If you feel stressed, post again and between us we'll see what we can do about cheering you up.

ex trouble

thanks for the replies looked on dilemas and shaz problem , there are alot of people with same problem.... ex'S going to court 16th oct with lots of paper work we have a good case whos gonna split a family up thats been together 11 years we can offer kid everything and more havent heard from ex sincehanded court order 4 weeks ago maybe the ground swallowed him up!! if any more help will be much appreciated thanks alot gotta go get some din din cant sit here all day bye.

Thought i would update on this issue.

Ex has refused point blank to sign anything agreeing for us taking our son to oz.
Has sought represention from his own solicitor.

However has agreed to the mediation we have offered( This may be his decision or most likely the advice from his solicitor)
Nevertheless hopeful we can organise satisfactory contact and travel agreements to allow us to take him with us to Oz.

Oh i can be so positive sometimes.
Awaiting the courts recommended mediation company to get in touch.

Has been an upside to this he is always on time for access and has gained some manners!!!

Failing mediation we will have to apply to the courts and devise a package to convince them that Oz is a better life for my child.

Hope the update of procedure is helpful.

Oh we have been advised that this can cost up to five grand!

Massive headache time, I send my wishes to you.
If you have a good case then you should be ok. I can't see why a judge would prevent your plans to improve your childs future especially as "father" has been absent for so long :!:
How does your son feel, regarding his "father" trying to prevent him going?
If your son wants to migrate then the court should and would take into consideration your son's "true wishes and feelings"
Could your son write to "father" and express his wishes and feelings?
How do you feel your solicitor is performing?
To save cost, could you go L.I.P. with a McKenzie friend?
My heart goes out to you both, it's a very sensitive situation especially for your son.

yippeee wacky jacky heer well we all went to court last week including my 13 year old and guess wot? his dad who wouldnt sign for him to emigrate never showed up so judge just said why wont he sign has he got a good reason or is he just being akward? i said being akward judge clapped his hands said ok there you go we were gobsmacked he said theer is your court order OFF YOU ALL GO TO YOUR NEW LIFE IN AUSTRALIA and that was it .so medicals and checks next. my son was let down by him big time and if he wants to see him now its too late . so if you can go court on your own its worth it

Ex husbands!!!

Can anyone help with ex husbands and court cases?? My partner offered job in Adelaide so have got to get ex husband to agree to let my twin girls go!!! He has said he may stipulate conditions of signing. Anyone been to court that can help, advise. girls see him once a week if that does not have much else to do with them, how do I go about sorting it out???? Help needed.
