Hi Guys,

I am priority 5 applicant (subclass 175 applied in jan 2009). I received below email from DIAC in July 2012. According to DIAC if i am able to get state sponsorship from any state, i need to inform DIAC and they will change my visa category under same fee. Anyone got state sponsorship after july 12 and had his/her subclass changed without paying the visa fee? Any thoughts how to do it after july 12 because mostly states offering 190 visa which i assume cannot be changed to from 175.

"I am writing to you concerning your General Skilled Migration (GSM) 175 application lodged on 23/01/2009 .

The Government recently announced 190,000 places for the 2012-13 migration program year. This includes 129,250 places for the Skilled Migration Program including Skilled Independent, Employer Sponsored, State and Territory Sponsored, and Skilled Australian Sponsored (Family Sponsored) applicants.

See: Australian Immigration Fact Sheet 20. Migration Program Planning Levels

The Minister for Immigration and Citizenship has set new priority processing arrangements for skilled migration applications, which took effect from 1 July 2012. Information about the priority processing groups and the order of processing applications is available on the departmental website.

See: Priority processing groups and order of processing applications.

As at 1 July 2012, there were approximately 16,350 Skilled Independent cases representing approximately 27,600 applicants in Priority Group 5 awaiting allocation. As such, many Priority Group 5 applicants still face a considerable wait until their application is allocated to a case officer for processing.

You can follow the progress of GSM applications being allocated to case officers on the departmental website:

See: Allocation Dates for General Skilled Migration Applications

As you have not been nominated by a state or territory government, and your nominated occupation is not on the SOL in effect from 1 July 2012, your application is in priority group 5 for the purposes of priority processing arrangements

As your GSM visa application was lodged before the legislative changes made on 1 July 2010, you are eligible to seek a nomination from any state or territory government.

When seeking a nomination from a state or territory government agency you should consider whether your nominated occupation is listed on the current State Migration Plan (SMP) for your intended state or territory.

State Migration Plans commenced for all states and territories in late 2010 and early 2011, and list which occupations state and territory governments can nominate applicants under. States and territories have a limited capacity to submit nominations for occupations not listed on their State Migration Plan. These provisions allow states further flexibility in providing nominations which may be valuable in meeting shortages in very specialised occupations.

It is important to note that it is entirely at the discretion of the state or territory government agencies to nominate applicants and to submit nominations of their choosing to the department. Once a nomination of their choosing is received by the department, it will be considered and the nominating agency will be informed of the decision.

If you are able to obtain a state or territory nomination, and meet the other eligibility requirements, you should email a completed Form 1022 togsm.documents@immi.gov.au notifying GSM of a change to your visa application category. Your visa application category will change once your nomination has been submitted to the department by the state or territory government and approved.

You may also wish to consider alternate visa options including:

- considering your eligibility for an employer sponsored visa, which would require a new visa application

- submitting an Expression of Interest (EOI) for another skilled migration visa through SkillSelect

Information about SkillSelect can be found on the departmental website.

See: SkillSelect

You can withdraw your application at any stage during processing if you no longer want to be considered for the grant of this visa. Information on how to withdraw an application, along with other information for applicants who have already lodged a GSM application, is available on the departmental website. Applicants who do not wish to continue their application and withdraw for this reason, are not eligible for a refund of the visa application charge.

See: Application Already Lodged - Professionals and other Skilled Migrants - Workers - Visas & Immigration

Further information on the processing of priority group 5 applications is available on the departmental website:

See: Processing of Priority Group 5 General Skilled Migration Applications

Hi,

Yes. I applied 175 on july 2008, and converted to 176 with state sponsorship on around 20th july 2012. You can proceed like this as per the DIAC letter.( No extra charges for visa). But depends on state, they will charge you for the sponsorship. WA-200 A$, VIC - Nil, etc.

Check for which state has your occupation and apply. Once approved and you sign the agreement with state, they will send the notification to DIAC and you will get alloted to CO.

Best of luck.

Cheers.

Thanks for your reply ompragrash! I have a confusion. My occupation is software engineer and i was eligible for NSW state only so i applied there for 190 because they are offering state sponsorships under 190 not 176. If i get NSW sponsorship which is ofcourse under 190 subclass I should notify DIAC for change of visa and they will change my subclass to 176 based on 190 approval letter from NSW? Sounds odd to me. Hope you can explain.

Can you please share your information? when and which state you applied for sponsorship and was it 190 or 176, what documents you sent to DIAC after sponsorship approval for change of visa?

Regards

Hi reehan,

Okay..., Let me explain. The application who lodged before July 2010 are eligible for state sponsorship.( because of legislation they changed in july 2010). So 175 visa can seek for sporsorship with state which has the limit and occupation in their demand list. They say SMP. So our case we applied before july 2010, are entitled for a sponsorship and after approval will be considered as 176. It will not become 190, because 190 is under skill select which started Jult 2012.

Dont worry, when you try to apply state sponsorship with NSW, there will be coloumn whether 190 or application lodged before July 2010. So you can select the second option.

Once you fullfill all the documents they ask, they will approve your application and they will send form 1100 to DIAC. Attach the approval letter and down load form 1022 ( fill it up) and send to DIAC. ( to the same mail which above you receive). form 1022 is the form for notification of change.

After this, its all DIAC has to come back with CO allotment and etc.

hope the above details would work.

Mine is SS with WA. I got SS in one week and after submission of 1022 with DIAC, I got CO alloted on the following week.

cheers.

  • 1 year later...

Thanks ompragash,

This is exactly the info I needed. I applied 176 FS in 2009 before the legislative change. They emailed me the exact letter as reehan received only that I had my occupation removed from sol. I am now trying to get qld ss as they are sponsoring my occupation. My agent asked me to redo my ielts and vetassess and submit eoi to qld. After we get invitation to apply, we will try to update DIAC via form 1022. We hope we do not have to repay the visa charge again.
