      Western Australia State Sponsorship refused for subclass 573 Visa holder.

      Hello friends,

      I recently applied for a State Sponsorship for WA as Office manager for Visa subclass 176 and it was refused.
      > I have skills assessment for office manager from Vetassess done just 2 months ago and it is positive and IELTS with overall band score of 8, each band over 7.
      > 3 years part-time work experience in the same occupation. (i am still working in NSW as an office manager)
      > 2 Bachelor's Degrees from my country of ORIGIN.

      I am currently on a subclass 573 dependent visa. My wife is a student and i am her dependent, even though they refused my application. The reason for refusal was, "RECENT AUSTRALIAN GRADUATES FROM ANY AUSTRALIAN INSTITUTIONS OTHER THAN FROM WESTERN AUSTRALIA, NEED TO HAVE A 12 MONTHS WORK EXPERIENCE IN WESTERN AUSTRALIA PRIOR TO LODGING THE APPLICATION." SINCE I DIDNOT MEET THIS REQUIREMENT MY APPLICATION HAS BECOME UNSUCCESSFUL.

      But, hang on man...." I am not a student, i have never been to a Australian school, i have never studied in a school/college/uni here in AU. So why are u referring me as a RECENT AUSTRALIAN GRADUATE.?????????????????????????

      I have submitted an application for a review yesterday. Hopefully, i will get to know, about the outcome sometimes today.

      Is there anyone who had similar situation? I am so stressed.......! ANY HELP on this matter will be highly appreciated.

      Have you spoken to a Registered Migration Agent.

      From the Online Application Form of WA SS you put what sort of visa you currently hold - as you put Student Visa (there is not option to put secondary applicant). Did you put anywhere that you were the secondary applicant.

      Hopefully you will get this sorted. Maybe be giving them you visa number so they can check that you are the secondary applicant - or prove that your wife is primary applicant by proving her student status.

      Thank you for your advice. I have already, attached my visa along the email. I have even provided them with my wife's diploma certificate which she completed last year. I have written 10 times over different spot in some emails i sent them that I AM NOT A STUDENT HERE, MY WIFE IS . Despite, that is what i got.........! THIS IS UNJUST....! I am get desperate over this....and am waiting until there office re-opens today so i can talk to them over the phone......! Any other advices you have on this.....!

      My wife is not a primary applicant for the SS, i am. She is not applying the SS, i am. I came to Australia with her as her dependent. She is a student and i am her dependent. I accompanied her to Australia on her visa. But I am the one who is applying for SS. I am not an Australian Graduate, that's why i applied for 176 (offshore), had i been a recent graduate i would have to apply onshore, since i am not, i applied offshore (176). I meet all the requirements, even though, they have refused me.......! I have not consulted any MARA agents...i thought i could do it myself, i thought once i have the approval letter, i will go with them to submit my visa application and this is what i have got...........!

      We had our vista extended on Feb 2011. We don't have a label on our passports as we didn't need it. We have a direct email sent to us by our case officer DIAC. I printed the whole email out, which has the TRN, Visa number and visa conditions, no. of people included, and their limitations and conditions and other stuffs included the email, SCANNED IT and SENT IT TO THEM as attachment................DESPITE this is what i got.....????????????????????????

      I meant that your wife was primary applicant on student visa.

      I just had a chat over the phone and lady who i spoke to wasnot very interested on speaking to me. I explained the situation and she said still it will be refused. I said i am not a student.....and she said, you are in Australia so, you should be living & working in Western Australia for the past 12 months or you will need to show work experience other than that of Australia......? When i asked, but the information in your site is inadequate, it only mentions about Recent Australian Graduates whether In or Out of western Australia......she said, the information is there...." AM I BLIND PROBABLY..".........I said, i have submitted my application for further review....and she said, they might check on it, but it's very likely they will refuse it.......!.............. HEART BROKEN...........!

      I would still try and speak to a RMA, as 176 is offshore visa. Often people that deal on help lines and not qualified to give you tge correct answers. DIAC helpdesk often gives wrong info and they are not accountable for what they say.

      Thank you for your advice. Ok i will speak to them now...! and will let u know, what the outcome is...! until then , i keep my fingers crossed my review application is accepted and the decision is in my favour ....Cheers..!

      Same thing happened to me and my application was refused giving the very same reason. I am secondary applicant on my husband's visa and had studied two units from USQ online. I had positive skill assessment, IELTS 8 bands and my previous qualifications were recognised by ICAA. I applied for review and tried explaining to them studying just two units 'online' doesn't make me 'Recent Graduate' but to no avail. I agree their website does give misleading info about this and they need to understand the definition of 'recent graduates' better. In their eligibility criteria, they require international students to provide study completion letter for the duration of two years and going by that criteria, I don't understand how they termed me 'recent graduate' from my four months online study. I believe they failed to distinguish that I was applying as an off-shore applicant who just happened to be on-shore on her husband's primary visa. Thus I guess actual off-shore applicants stand better chance of approval from WA.

      However you still have better chance of getting positive reply in review as you never studied in any way in or out of Australia from Australian University. So all the very best for that and hope you hear good news soon. Cheers.

      Applying for state sponsorship is not the same as applying for a visa. With the visa, if you tick the boxes and meet the criterai you will get the visa, with state sponsorship it simply is not the case, it is more like a job interview process. Sometimes you just don't get it, even though you believe you fit the bill.

      I don't know if you have seen all those threads from people who take sponsorship from one state even though they have no intention of living there? Anyway there are a lot and it is often commented that states should tighten up, I think that you are feeling this kind of impact. You are settled in another state and they are worried you are a risk of being one of those people that will take the sponsorshp and not move to Western Australia. Of course I am not suggesting this is your intention, but I expect this is where it comes from and really whether it is you or your OH is largely irrelevant to them.
