GSM & RSMS Visa - What do to do!! CO appointed for GSM ..but not RSMS

Hi,
I applied for my visa subclass 885 in Aug 2009 and because of the long wait, my employer decided to sponsor me on an RSMS visa (119) I put in the RSMS visa application on 23rd April 2012.

Now the problem I face is that I have got a case officer assigned for my 885 application. In my 885 application, I wasnt in a relationship nor was I married and hence didnt have my partners name in that application. Unfortunately I cant add my partners name to the 885 application. The RSMS application however has my partners name in the application and when I get my PR, she too would get hers. I have spent almost 10k on migration agents and application visa fees.

I have already emailed my CO informing her about the situation and I am waiting for her reply. In the meantime, just wondering if there is someone who was in a similar situation. I dont want to spend more $$$ on a new spouse visa application as it will take another 5-7months to get that approved. I am still on the waiting list for the CO to be appointed for my RSMS visa and hence I havent been assigned with a CO.

Any ideas on what to do???

What advice has your RMA given you?? It would be best to ask a RMA this question rather than you CO as they are not able to give you migration advice.

My migration agent is on leave, but spoke to her colleage who said that she would look into this for me tomorrow. I just wanted a quick answer from someone who may have been in a similar situation. I am tensed and worried at the moment... :-(

You should wait to see what your RMA will say - not many people would be in your situation - but there may be an issue regarding the fact that your are likely to be on a bridging visa waiting for the decision of the 885 visa, and withdrawing while waiting for the 119 (offshore), you would have no rights to stay in Australia.
It is a difficult situation.

yeah, that is right. I cannot withdraw my 885 application because that would mean exiting the country. At the same time, if i continue with the 885, my wife will have to apply separately on a spouse visa, that means additional paperwork to get her Police clearance and other documents + extra expenditure for the spouse visa + 7-8 month delay in getting her to Australia.

Just wondering if the CO for my 885 would consider holding the application for a month or two and me trying to get my RMA to expedite my RSMS visa application.. Dont know if that is possible.

You usually have 28 days to give additional information to your CO so you should have time for your RMA to work something out for you.

Why can't you add your wife to the GSM application?

because when I put in my GSM application, i was single and not married.. Immi rules do not allow me to add her name after the application is submitted to DIAC, she would have had to be onshore for me to add her name to the application when it was submitted but that time we werent even in a relationship..
