      Changing Sponsor on 457 Visa

      Hi,
i was wondering if anyone had been in this position. I've joined a company and started working in the coal mines in central queensland. I have been sponsered by the company for the 457 visa but i know really want to get out of this company. Unfortunately the company has demanded everyone working on this project to work 15days straight which is exhausting. I'm not the only one look to leave.
I wanted to know if the 28 day limit of finding a sponser from leaving your current one applies from the last day you work on your notice period or is it counted from the ay that you put your notice in? I've been trying to find out but not had much luck.
I was wondering if it was wise to leave a company and ty and find a new one as soon as possible, or to find a new sponser/employer before putting the notice period in?

Any help on this would be great as this job is demoralising everyone.

      Thanks

      Hi
I think i read it starts when Immigration recieve the paperwork. In your position i would be seeking another employer to take over your sponsership before you leave your current job.
      Good Luck with everything

      In a similar position

      Hi

i`m here on a 457, just over a year, and the dream has become a nightmare. My friendly , helpful boss is now a micromanager who is kranky most days which ramps up the stess, and you make more mistakes. A colleague who was also a 457 migrant lost his job just before Xmas (same day as the Xmas Barbecue !). His last day was after the 28 day period was mid Jan, but to date he hasn`t been contacted by Immigration. He has a job lined up and is waiting for references. Have read posts in here where people have said that hey haven`t been contacted, i got the impression that if you are serriously looking for another sponsor they will be sympathetic.

In your position, i would look to get another employer before leaving, which is easier said than done, esp if it means travelling out of state etc for interviews. My stress levels are too high, talk through with someone, even on here, it can help.

In my view, after going through DIAC website and FAQs of 457, there is no notice period as such. It depends on your negotiation skills, if you may wanted to go back to the same employer in future. Otherwise, you can simply look for a new sponsor. DIAC only say the maximum period without being employed is 28 days. Also, make sure that there are no dues against you when you leave organisation. Any overseas agreement made between you and your employer is not legal in Australia, only local labor laws apply here.

You can provide you workmate's contacts for reference, it's not compulsory that your employer provide reference to you.

      Good luck mate!!

Wow, you described how we were being treated in our last job. Sorry to hear your having the same problems we were. I think it may be a australian way of managing over here. I couldn't stand it any longer and left the company I was working for. Since then I have been talking to the DIAC for advice and was told that the 28 days starts from the last day of your employment. So pretty much the last day of your notice or when you officially leave. Saying that tho, I was also told by DIAC that they are not strict with the 28 days and give extensions if your actively looking for work. Even then, if your having no luck they can put you on another visa to stay in Oz. I had talked to another company and was also told that its easy to switch your 457 visa with a bridging visa. Its pretty much all sorted on the company side of things. Thought this info might help anyone thats had the same problem as us.

I think all the visa advice has been covered. Basically you just need to get yourself another job / sponsor. I am curious though about what your official roster is and what job you do?

      hi
we are under 457 visa sicne 2 years in OZ and my husband īs current sponsorship want to cease the sponsorship.
we are currently looking for a new company to sponsor our visa still valid up to 23 May 2013 and we don t want to go back to europe
we are stressed by the time allowed to find another sponsor, but further to your message, it seems less strict as we thought
how long can last the bridging visa and when do you have to apply for this visa ?
by any chance do you know how to find a list of companies which can accept 457 visa holders ?
      thanks for sharing your experience
