  1. still waiting... So this morning I finally received corospondance from the VACCU. I have received an email with the heading Issue of Notice of Intention to Consider Refusal under s501 of the Migration Act 1958 They have essentially given me another opportunity to provide them with a character test. Not looking good and after so much time it feels as if this will be declined. Although on the up side, don't they normally just refuse? Can someone help, this was the body of the email that I received today. On 03 November 2015 you applied for a Working Holiday (Temporary) (Class TZ) visa. The to notify you that consideration is to be given to whether this visa application should be refused under s501(1) of the Migration Act. Under s501(1) of the Migration Act a Minister for Immigration and Border Protection or a delegate of a minister (the decision-maker) may refuse to grant a visa if the visa applicant does not satisfy the decision-maker that he or she passes the character test. The definition of ‘character test’ is included in Attachment 1. This notice does not contain all of the information that may be important to you. After you read this notice in full you should then read Attachment 1 and Attachment 2 and each enclosure to help you understand the character refusal consideration process. The Department of Immigration and Border Protection holds information about your criminal history listed at the end of this notice, which suggests that you may not pass the character test by virtue of s501(6) (d) of the Migration Act. subparagraph 501(6)(d): in the event the person were allowed to enter or to remain in Australia, there is a risk that the person would: (i) engage in criminal conduct in Australia.
  2. I've got a thread on my profile you should read, I have very similar convictions - battery but x2 drink driving convictions & class a not class b & also immitation of a fire arm (Bb gun when I was 15) I applied for my visa in October a 417 whv and I am still waiting! Your application will more than likely be similar process to mine, send off for an acro (police check) then send them back with detail character references & then probably will get passed over to the VACCU (Google them if your unsure) basically they are a governing agency. There has been a lot of cases then got through & although they seem bad on face value, they understand people have a past. Good luck k mate!
  3. Hi Arthur, I am in a very similar boat, I have a criminal record and have a post on "posinoz" - http://www.pomsinoz.com/forum/migration-issues/241144-will-my-criminal-conviction-allowed.html#post1936851607 (if you would like to read that, may give you more of an insight as i have tried to update my process along the way). I just wanted to add that I got an email from the VACCU which that my application had been processed and there isn't a time frame of when this will be finalised. However I never received an email stating that it may take up to 6 months... (I received mine on the 30th of November and I am still waiting) I wish you all the best in receiving you visa bud! Regards, Barrystock
  4. Hi Liam, Have you heard back from the VACCU yet? I had receieved an email on the 30th November saying that had received mine, however I still haven't heard anything back. Let us know how you get on mate & good luck!
  5. The employment letter had to be 6 months, which is what I had received. I am am however still waiting for the minister to sign off my application. Have been patiently waiting 6 weeks since this was advised and starting to panic, as my employer has asked and wanted me to start in Feb, I don't know the maximum processing times it can take. I will ill update this post as soon as I hear back. I hope this helps anyone. have a great new year.
  6. Hi All, Just an update, I have received an email and when logging onto the online.immi.gov.au website. All I was asked to do is provide a character reference and also provide evidence of my convictions (ACRO). I am currently waiting to hear back from them, not sure if this is a long process, but I submitted 4 references, my contract from my employer over their and the ACRO certificate and just my perspective of all my convictions in detail. I hope this helps, I will continue to update you, regardless if I get accepted/rejected. Fingers crossed though as I have a really good opportunity, can anyone comment on their experiences of this happening to them. Thanks, Lee
  7. @jac2011 I know I am very much "pushing my luck" however I have to try. I have submitted my 417 WHV this morning, it hasn't asked me to fill out any forms i.e. "form 80" is this something that they ask for later down the line? I do have my ACRO certificate which has all my convictions on, however it hasn't asked for any documents as of yet?
  8. right, so I know this is one of them stupid questions that everyone has asked and pretty much no one can answer. However, I have sent off for my visa today and have declared all of my 7 criminal convictions, starting from when i was 15 (immitation of a firearm(got caught with a BB gun)) to possession of cocaine to 2x drink driving convictions. i haven't been to prison and have only received reprimands to cautions on all of my convictions. Does anyone have something similar to this or worse that has been granted access to Australia? or does anyone know my chances of being able to get it. I have a extremely good job offer from 2 recruitment companies in sydney within a really needed market and want to know if my criminal record will be an issue. Thanks,
