hi
my wife has worked in caring for the elderly and people with disabilitys for the last 13 years.
would we be able to move to melbourne on her terms, she has NVQ3 qualifications.
not sure if it helps but her sister is a resident in oz as well.
there is myself my wife and our 3 year old son who want to move there.
The link is to the main ASCO Code. Go to page 460 and then scroll forward to Page 465. You will see that Aged or Disabled Person Carer is listed under Code 6313-17. The detailed job description is on Page 466.
As you will see, the permanent RSMS visa may be available because this is an occupation that is within ASCO Groups 5-7.
Leaving the possible visa aside for the moment, the next thing is to consider a possible skills assessment (though that is not absolutely essential for an employer-sponsored visa, but because the work involves vulnerable people it would probably be very sensible to try to get a skills assessment, I suspect.)
This is where I start to get woolly and vague because I am not a migration agent so I have no experience of doing anything like this for real, so to a great extent I am relying on a combination of logic and guesswork here.
My guess is that the skills assessment body would be Trade Recognition Australia (the good news is that their fees are only $300) and that you would be looking for a positive assessment under TRA skilled Pathway B. Please see here:
Make a point of clicking on the link at the bottom of that article, to the Uniform Assessment Criteria. Wade through that a bit and you will come to a Table showing the different TRA Pathways, and I find it easier to work with the table and the article together.
Not that I am any sort of expert, because I do stress that I am not, it looks to me as if a positive assessment under Skilled Pathway B is probably possible?
I am not sure whether all 3 of the skills exempttion conditions have to be satisfied before an RSMS visa would become possible. The thing does not say “one of” so for the moment I assume that all 3 factors would have to fall into place but I am not certain because one of our other members told me recently that he is unable to get a positive skills assessment because he has no formal qualifications.
Nevertheless he is a floor finisher (though that is on the MODL.) He wants to go to South Australia and he was offered a job and a 457 visa to go there. He said he wanted immediate PR via an RSMS visa instead. The employer agreed and our member’s Registered Migration Agent says that the idea is viable.
Given that your wife might well be able to get a positive skills assessment anyway, I wonder whether the idea of two years on a temporary 457 visa can be eliminated not withstanding that it is not a Group 1-4 occupation? Dunno. I would assume 3 years in total on a 457 visa before an RSMS visa could be granted because I imagine it takes time to get all the paperwork ready for the RSMS application and that it then takes time for DIAC to process it etc. However that is not the end of the world if you want this badly enough and both of you are prepared to work full time in order to make ends meet.
Whatever the answer to the above query is, the employer would have to be based in “regiional or low growth metropolitan area of the relevant State.
Do the rest with the aid of Google Australia followed by Google Maps, I suggest.
If you manage to find an employer is “regional” Victoria, it is a tiny State compared to any of the others. If you have to live miles from your sister in law for 3-6 years it is not necessarily the end of the world and neither is a different State altogether if push comes to shove, I suggest.
I don’t know whether any other visa might be possible other than an RSMS in the long run but it may be worth ringing round some migration agents and picking their brains.
Best wishes
