Unhappy Help!!! Police Check's

G'day all!

If anyone could help us with any advise we would really appreciate it!! We are stressing out today!

I've just received my police check this morning, Shelias came back fine but mine has come back with Prosecution/Conviciton for Theft and Kindered Offences 1996. This was back in 1996 when my friend and I was foollisly got drunk and smashed a shop window. We both admitteed to a theft charge to get a lighter sentence. I was young and foolish and now over 10 years later worried this is now going to effect my visa application. We are at the last stages of our application and after all this hard work feel we are not going to make it?

I thought Police Checks would have only gone back for the past 10 years and previously crimal history cleared?

Could anyone please give us any advise if this is going to effect our Visa decision.

We are not sure where to go for here..., should we just send my Police Check to our CO and see whats happens or should we go to a Solictor to see if I can clear my police record or get further legal advise!!

HELP!!!!

Hi Bruce

Relax. There are soooo many people on this forum who have had minor offences on their police checks and I am sure they were all fine.

If you do a search for other links concerning this there are some people with far worse convictions than yours.

I am sure you will be fine

Hi Bruce and Sheila, please relax as kim says there are people with far worse convictions than yours who have gained a visa,i think it only really matters if you are a persistant offender and or have served a sentence of 12 months or more, relax and let the dream happen, Billy

Hi Bruce

Kim is absolutely right. What sentence did you receive? That is more important than the offence with this stuff. If you received a custodial sentence, it will be examined in rather more detail than if you did not.

Did you forget to mention this offence at the time of making your visa-application? If so, write tio your CO explaining your oversight, apologising etc and explaining exactly what happened.

dont worry about it

I should'nt worry too much, maybe check with the solicitor as uk records for minor offences are not supposed to be kept longer than 10 years.
BUT a guy i worked with in the uk around 6 years ago had spent time in prison and he is now living happily in redcliff (Queensland)
Dont worry everything will come good.

Thanks for your reply.

I only had to pay compensation for the damage. No sentence or time in prision was spent.

Not sure how serious theft and kindred offences is in the law for buglary and theft non dwelling.

I would have thought this would have been cleared after 10yrs from my record?

Wink re police checks

Hi,
dont worry ... my husband has aprox 9 convictions (varied) from a mispent youth so we have looked into this closely, it appears that as long as you have not spent more that 12 months in prison on more than 2 occassions it is not a problem thank god as that would be our oz dream over!!
